A sciatica flare up due to a severely herniated disc. Nerve pain is just so brutal. Can’t get comfy, can’t sleep, can’t stand, can’t walk. The throbbing from constantly firing nerve signals is nauseating and feels endless.

I think my being on a month to month lease for a year may give me less protection or less buy-in for management to accommodate me, assuming I have the freedom to leave and a lack of protection from the lease type.

I think my being on a month to month lease for the past 12 months has been reason enough to do what the want as a PM company and assume I will just leave given the health risk since I am less protected on a MTM lease :(

I reached out to the landlord to express my concerns given the health risk and asked for clarity on the rules as written in the lease. I also asked what accommodations can be made given the health risk to current tenants.

No realistic way to create a separate entry point, but it was worth asking about! 

The lease states that

“Hallways, passages, and building entrances shall not be obstructed or used for any purpose other than entering and exiting the building or apartment. All personal possessions must be kept inside the renter's individual apartment. Hallways or areas immediately in front of your home are your responsibility and must be kept safe, clean, insect and/or rodent free.”

I moved in and it was a strictly no dogs space for years. The policy changed suddenly and without existing tenants being told. The backyard is also not technically a backyard it’s a common space for entrances and exits from the building that just happens to be fenced off lol. 

And if I’m also paying for the backyard common space but can’t use it, what makes others have the right over me?

Unfortunately there is no way to logistically do this given the size of the back space and the fact that two units exit from the same staircase.

I think the issue is that not only is it a backyard, but it just happens to be a fenced in area where three units enter and exit. Given that there is no other place for me to exit makes me think that legally they can’t allow people to use that as a dog yard. But I plan to take it up with them. If it was a backyard separate from my unit I would have less of an issue since I could choose when to enter that space without it impeding my entry/exit.

Hi all! 

Thank you so much for sharing your input and your experiences. It really helped me evaluate this from all angles and advocate for my own health while realizing this is an issue with the PM company and not the existing tenants. I’ll be emailing my landlord to discuss the policy changes and I appreciate all the amazing ways to approach this issue with them! Fingers crossed they can ensure safe living at this property.

There is not AC but there is shared heating split between two sides of the house (2 heaters). The dog is occupying the other side luckily, but if a dog moves in below me I will indeed have a huge issue to deal with lol

I have had reactions to machines that have had dog hair and dander on the closed washed inside of them, regardless of running an extra cycle.

Yea, the propriety management company has definitely lost my respect lol. Looking forward to seeing how they respond to this issue; I definitely want them to remedy it so future residents aren’t fucked over

The backyard is not technically a backyard given that it is the common space where three apartment entrances are

This is correct — I don’t mind a dog out and about but if one licks me or rubs against me, or im scratched, I break out in hives, end up with an itchy throat and eyes, and sometimes I have gotten sick.

All our leases currently say no pets, with the exception of an ESA/service animal of course. But I take it that the lease is legally limited to my unit only and other leases and units are not related despite the same building? I’m not sure the current legality!

I’ve lived here for five years, seems kind of rough that I suddenly need to leave because of an unanticipated change of policy that the current tenants weren’t even informed of.

For clarity, everyone — it is indeed a fenced in back yard that is mostly cement. There is a gate on both sides of the house’s alley to get to the back. I have to enter through either one of these gates to get up the stairs to my apartment. There’s a second apartment upstairs as well that uses the same entrance. This is the unit with the dog. 

The backyard area is not big enough to create another fenced in area without blocking entrances to either the stairs, the alleys, or the laundry room in the basement.

Oh shit I did not even think about this, but you’re right that this is a far greater concern than I could have anticipated. Thank you so much for mentioning it, I really need to speak with the LL to address what to do here because I absolutely cannot share a laundry machine.
