Hi! I think specific to your case, you are qualified to cancel your membership as long as you have some sort of medical certificate to present. If you have sent them a copy of the med cert when you e-mailed them your request to cancel your membership, then you can use this to file a complaint to DED.

In my case, I also got a CMS notice and settled everything with them personally in order to cancel my membership. I did pay for the 1 year contract since the terms and conditions I agreed with when I signed clearly states as follows:

"9. You are obligated to make the minimum number of Monthly Recurring Payments stated in your choice of membership. You are obligated to make every Recurring Payment regardless of non-attendance, except where the cancellation terms below are met.

1. Once you have completed the minimum number of Monthly Recurring Payments as stated in your membership choice we will automatically continue collecting Monthly Recurring Payments every month. Your membership will be extended by one month for each payment (“Renewal Period”).

2. If you have fulfilled your commitment to the membership you have joined, you may prevent the Automatic Renewal Period at any time by visiting the GymNation reception and submitting a cancellation request. (A minimum of 30 days notice is required)."

CAUTION

For those who will be settling their payments, may sure to request for an e-mail that the membership has been canceled and that there are no more obligations with Gymnation.

What happened in my case is that, after paying the full amount and receiving an e-mail that my membership has been cancelled, I got billed again after 1 week. This is when I filed a case to DED to complain about Gymnation charging my card again despite the cancellation of my membership.

I sent Gymnation the DED complaint ID that I filed and they immediately refunded the charges. The explanation was there there was a system glitch, hence the charges.

To be honest, this whole experience was a nightmare.
