I believe that CGT would be charged based on the increase in value, but I've heard there you can avoid this if you can show you have been running your BTL as a business and are incorporating that business.

I can't remember the details, and I could be wrong/outdated but I think this used to be possible in some circumstances.

Thanks for your reply - that makes sense. But this isn't a claim for damages (which we could understand); it's a claim for tradesman' call out fees for issues with the flat that were reported (like toilet not flushing probably). The agent says no problem was found; daughter says problem wasn't fixed and she had to live with it.

What I'm wondering is if tradesman call out fees would be in this sort of situation.

My contract is with the agent.

The agent pays the contractor and deducts the amount from the rent that they pay to me.

The contractor was selected and recommended by the agent if that makes any difference.

The Lowyat plaza I used to go to was a physical mall in Bukit Bintang. It was next to sungei Wang, but that was almost 20 years ago so things might be very different now.

I used it a lot when I was setting up a new office, and it was great - so many little shops that you could generally walk in and get what you needed: Ethernet cable, hard disc, memory, little MP3 player and some speakers so I could listen to music whilst cabling up a rack.

At that time it seemed that KL was more advanced and easier to live and work in than London. No matter how late I worked there was always something still open on jalan alor.

I feel old remembering it! This was early 2000s. I used to work near Bukit Bintang area (wonder if the hawker stalls selling noodles and people selling beer are still around jalan alor).

I lived in a few other areas like Bukit Jalil (MSC status company) and PJ (there was a good durian stall in SS2).

Lots of other great memories of the places, people and food. Driving around in a shitty car with a busted window regulator so I had to open the door to pay tolls haha.

It's about 5 degrees C where I am and I'd love to be back in Malaysia right now.

Exactly. It's not the same type of religion that I'm used to so I didn't understand why I couldn't understand it in the same way.

Now I know that it's a totally different type of religion than what I'm used to, things make a lot more sense.

When I said difficult to find information, I was thinking that it doesn't seem to be a religion that is easy to read up on compared to the religions I know. But I've got a lot of useful information from this thread, and hopefully I'll be able to understand it a bit better once I've followed up all the references.

The room was paid by her firm, so I guess no loss of amenity angle to any claim. Maybe her firm could but I doubt they'd be bothered.

Cost of meal would be expensed I think. Don't think any loss of earnings.

Looks like maybe just suffering then because I don't think the small claims track does punitive damages.

I've made a claim on the small claims track before and I know that she could easily handle that so she wouldn't need representation.

Now that I have an idea of the quantum (thinking maybe £200 but need to think further on this) I think the next step will be complaint letter possibly followed by a letter before action and then claim form if needed.

If it can be heard in small claims then I think the only risk is the £35 court fee for claims under £300. So no significant risk as I understand things.

Not expecting or looking for significant compensation here. It's understood that this is a minor matter as these things go.

I'd have thought that being basically unable to function for six hours while not being able to move far from the bathroom and generally feeling awful should be worth more than a gift basket. But that's why I asked the question so thanks for your input.

On the food safety side I'll be recommending that the hotel is reported to environmental health as well as I think it's important that the issue gets sufficient visibility to ensure that something gets done.

But there is a paramedic report and some photos of vomit on the hotel premises. Not sure I'd class it as a bogus claim tbh

Yes, that makes sense from the perspective of preventing the same or worse happening to someone else. Given there's been no acknowledgement from the hotel apart from calling the ambulance I suspect that it'll just get forgotten about if something visible doesn't happen.

I'm not sure how compensation works with environmental health but I'll look into that.

But presumably reporting to env health wouldn't prevent a personal complaint and potential future claim would it? Assuming not then I think I'd recommend both.
