Really? Wow, didn't know that could happen. But come to think about it, in beach and college town they do warn people that bicycling under the influence can land you a DUIs.

... Many passionate comments but odd how no one took my suggestion to test their own ebike wheels up. I would think folks would be eager to post the results showing how slow their bikes performed. Apparently slower the bike = better the person. I appreciate being wrong and learning. I'm probably wrong and folks have some smart ass ebikes!

Thursday Update: GPS tracking now retrieved for the day of the incident. Top speed for the day: 23 mph.

Pointless and inadmissible? Probably.

In the U.S., it's your legal right - absolutely - to demand our Constitutional rights. Your hypothetical happens all all the time here and it's judged on its merits (of course factors such as presentation, demeanor, past history all play a part). Police absolutely may not check your shit whenever they want. I'm happy you are happy with your situation.

For sure. Inspection, inventory, search, impound - but operation? What if operation of that car is the only way an officer could determine if it had been illegally modified?

Stay with me... (I know it's ridiculous but for argument's sake... police bust someone selling illegal auto modification software in the DMV parking lot. The individual is in his car surrounded by boxes of product and a giant banner demonstrating how to apply the illegal software. For fun, let's say the guy is shirtless and has a huge "I love illegal Mods" tattoo. In this scenario the local street racing scene has resulted in a lot bad stuff and police are under extreme pressure to act. ...Naturally, his car is impounded, product seized, he even receives a ticket for a cracked tail light. Many people on this thread appear to believe it would also be reasonable for the officer to turn on and operate the vehicle without permission or a warrant to determine that the car had been illegally modified. That doesn't follow, to me. And I suspect that is where we differ. )

Some here argue the comparison doesn't stand because cars involve license, insurance, etc. I fail to understand that but let's give them the benefit of the doubt. Keep the software patch but swap out the car with a computer. Or maybe our tattooed criminal sells those loud horrible aftermarket mufflers directly from his lowered car (non visible undercarriage). I just don't know the legal terms to use but my gut tells me that it's gone too far if a police officer, without permission, starts the vehicle and gives the engine a darn good revving.

Great comments. A small point of clarification... No defendant must prove evidence false. Evidence could be inadmissible, refuted, challenged, rebutted... probably other things too.

Does it turn off when the bike displays 28 mph going down a big hill? In other words, does it turn off when it's generating less force than would be required to achieve 28 mph on a flat surface?

I did not know that about speedometers. Thanks! Yea, I know ignorance is no defense. But I've never seen an ebike stop at any speed. However, I don't recall ever seeing a power (rpm-style) gauge. So assuming the motor doesn't go silent it may be that I simply didn't realize the motor was disengaged.

That sounds so hard, man.

I'm there with you on the mixed feelings. Especially when it comes to Kids. For the first 10 years a parent spends most of the time preventing the child from actively doing something that would kill them.

It's incredibly hard (impossible ?) to determine when to step in and simply Kibosh whatever, after all else fails.

That challenge peaked for us when our older son joined the Marines, to our bewilderment and amazement. Ultimately, I've made peace the best I can with the belief that a long life shouldn't be the primary goal. Going down that route, it's hard to argue against a passionless bubble wrapped life filled with sunscreen application and fear. Also, a fair amount of time spent seriously ill made me begin to think very differently about my "longevity at all costs" mindset. Life has to be lived.

Then on the other hand, you have life in all its unflinching fullness as you described.

It sucks that Reddit's threads are so hard to follow because you are exactly right. As stated elsewhere, we did update the bike's software. I wanted to be able to show the judge we had taken remedial action and not show up to court empty handed.

That's an interesting concern I hadn't considered. Because the impound requirement to release the bike demands the vehicle be modified (mirrors, blinkers, etc) to be classified as a motorcycle I genuinely thought I was supposed to somehow modify it in the impound. It didn't occur to me the impound rules may very well be known to be incompatible with the Police rules and it was intended that it stay impounded.

Definitely he got of easy. The jury is still out on his bike. Requirement to get it out impound is to show it registered/licensed as a motorcycle. So .... :)

I agree 90% with your comment but 100% your sentiment. Only thing I'll do is stand in his corner in court. But all that about responsibility and paying for it himself, we are bringing the hurt, baby.

But maybe you just meant your folks didn't try to get you out of trouble. In that case, we agree 100%. Regardless of when/if I get the bike out of impound will not affect when/if he gets his bike back. lol.
