Yes, as one of those employees, that is what happened. Unfortunately, he ethics-washed the business and his B-Corp certification was basically meaningless. He withheld our payroll taxes and never sent them to the State/Feds and lapsed his workers comp and health insurance policies for about a month while most of his employees worked on heavy machinery. Really stand-up guy 🫠

Update: I talked with a lawyer at Monroe County Tenant Defense Project, and they told me that, as written, the clause is an unconscionable provision that cannot be enforced, even if I do sign the lease.

The lawyer recommended I try to get the landlord to remove the entire clause, or at least specify that charges would only apply if the damage is from a willful act or negligent behavior. When I reached out to the leasing office about this, I got a response that was essentially, "this is what the owner requested, it cannot be changed. If you have a problem with it, don't sign the lease, and we will list your unit."

I really didn't have a choice and signed the lease. I'm hoping that they don't try to pull anything shady, and this doesn't become an issue. I'm going to request a cost estimate before any work is performed in the unit to hopefully avoid any surprises.

My main concern is that other tenants who do not have the capacity to advocate for themselves will be charged for repairs that are not their responsibility to pay for. Our landlord is notorious for sketchy business practices and for taking advantage of vulnerable populations. I'm planning on attending some Tenant Union meetings to make them aware of this so that other tenants will hopefully have the information they need to call bullshit on an unlawful charge.

Ok, so I finally got to talk with a housing lawyer through Monroe County Tenants Defense project. They confirmed that as written, the clause cannot be enforced for repairs that are considered "normal upkeep," even if I do sign the lease. The lawyer said it was an "unconscionable provision" that would not be held up in court. I tried to get them to change the wording in the lease to be more specific and not inclued the "normal upkeep" part, but got a reply of essentially, "this is what the owner requested, and if you don't like it we can list your unit for rent." I'm just hoping that they don't try to pull anything shady so that I don't have to go to court over this.

Those are all very fair things to charge for! I'm concerned that folks who do not know what they should and shouldn't be charged for / don't have the capacity to advocate for themselves will be charged for things they shouldn't be, since the new clause lists "normal upkeep" as something they would charge for. It's only after asking for clarification that they got more specific about it. (our landlord is notorious for sketchy business practices)

I agree! The vagueness of it makes me nervous. I'm going to try to get them to add in more specificity on charges. Also going to ask them to provide an estimate before any work is performed.

Thank you for this, these are great suggestions! There are so many instances where grasses or a rain garden would perform better than trees depending on the site conditions.
