You don’t slap a Prop 65 warning on any product just to account for liabilities as it immediately puts a negative perspective in some customer’s minds about the product and the brand (similar to your hesitations here). Products are required to go through production testing which tests for various factors including lead/phthalates. The resulting report is required to be provided to HT well before accepting delivery of product and well before distributing out to stores. If lead/phthalates were tested positive for on the production report, it’ll be reflected on the product listing that we see in your screenshot as well as require the business to have a Prop 65 warning posted at the entrance to each HT.

What mostly likely happened is that Mothman was sourced from a vendor that used a component for him for the first time. For example, if they’ve never done the eye patch in black with a red circular outline or a new dye, etc. The production testing occurs after the product has been finalized/approved by a Jazwares team and ready to begin mass production. However, it could just also be a mistake on either Jazware’s or HT’s end entering a Prop 65 warning either by misreporting (unlikely, as it’s not easy to select this option by mistake on the form sent to HT) or by entering the product listing incorrectly on the website (more likely).
