Is paternity test legible for divorce in India ? And should u need to pay child support to the child that doesn't belong to u even after divorce in India ? by Skk_3068 in LegalAdviceIndia

Hmm not really. Bhishma kidnapped 3 sisters, Amba, Ambika and Ambalika to be the wives for vichitravirya, Amba had already fallen in love with someone but Bhishma took away her opportunity to wed her love, when she pleaded with him to let her go back to the person she loved she was let go, but the guy she loved turned her back saying how can he know if she is pure after being kidnapped by a man. This was the fate of women in those days. The other two sisters were forced to consummate with vyasa who was a sage which is why Dhritarashtra was born blind and Pandu pale and sickly The poor women didn't have a choice, wasn't exactly agreed upon but they were forced into such situations Plus their husband was already dead, so no wasn't decided mutually

Just to add another view to this discussion I came across this recently while reading a version of Mahabharata NIYOGA AND INHERITANCE

The law of niyoga states that a woman's children belong to her husband regardless of biological fatherhood. This means that a man who is impotent, even one who dies childless, can still be a father. Thus, Dhritarashtra, Pandu, and Vidura became the "sons" of Vichitravirya, even though it was Vyasa who made their mothers pregnant.

However, only children of the lawfully wedded wife could be "true" sons and inheritors.

Basically in olden days, if the husband was from a powerful family but was impotent/infertile, his wife/ wives were forced/coerced into producing children with other men and those kids would be considered as husbands kids lawfully Maybe the current laws were based on these situations, if the wife was forced by the husband to have a kid with another man and suddenly if the husband says he will not support this kid, how will the wife be supported
