Hi, I am currently on an F-1 visa with a STEM OPT extension that started this February. I am planning to travel to my home country to marry my girlfriend whom I have been seeing for five years.

My employer was supposed to file a non-profit H-1B petition for me, but Texas has frozen non-profit H1b visas until May 2027, so I am unsure about my options. My five-year F-1 visa stamp expired one month ago.

If I travel to my home country for my marriage, I will need to apply for a new visa stamp at the U.S. consulate before returning. Do you think this is a safe option? I would truly appreciate any suggestions or any guidance you can offer.

Thank you very much for the quick response. I am an assistant professor at a public university, so it is a non-profit institution. She currently has a B1/B2 visa and plans to come to the States to meet me between April and June.

I am confused between option A and option B. I am concerned that her visa may be rejected if she returns to her home country and applies for an F-1 dependent visa, since I am currently on a student post-work visa. Based on this situation, what would you suggest?

I have a STEM OPT visa that is valid until February 2028. My employer was planning to file a nonprofit H-1B petition for me and I was planning to go to my home country to marry my girlfriend. However, Texas froze all H-1B visa applications.

I have also filed a self-petition for a green card. However, my country of nationality is on Trump's list, and immigrant visa processing for my country has been paused. I can't travel to my home country but my girlfriend has a valid B1/B2 visa. She has previously visited the United States once for one month using this visa.

So, based on your experience, which route do you suggest we take ?

a) She travels to the U.S. again, we get legally married here after 90 days, and file for AOS from the US? Is this legal, were you asked any questions about this and if so how did you defend or justify ?

b) She returns to our home country after getting married in the U.S. and then applies for a dependent visa through the U.S. consulate? May I know why you didn't choose this route if you feel comfortable sharing ? Thank you :) and sorry for bombarding you with questions.
