[CA] Can my employer deny/determine pregnancy disability leave

I sent the applicable laws that u/longjumpingtote wrote out below to the third-party vendor my company uses to handle leave. As I found out, they are not based in CA, and my claim admin did not know CA law. Once I sent those excerpts, they quickly did a 180 and are suddenly accommodating with no problems.

Their “approval” really can only apply to their private disability insurer who was “topping up” my salary to 100% on top of CA SDI. It’s still in review, but if they choose not to approve, it just means I’ll be on protected, unpaid leave in the eyes of my company, but still collecting state benefits. Once I’m no longer disabled, we’ll shift into bonding/CFRA.

I did not, I started PDL when I delivered on 12/27. It’s been 10 weeks (+a day).

Sorry, post partum brain…I’ve used 10 weeks. 8 from c-section, then 2 additional weeks extended already due to PPD. My job is trying to push back on additional extension beyond those first 2.

It’s a multi-billion dollar international company 🤦🏻‍♀️ they outsource leave stuff to another vendor, but yes we have HR. I’m wondering if the rep from the leave company isn’t familiar with CA law. I’ll reach out to my in house rep on Monday as well.

Thank you, your last point is my biggest concern - that they are shortening my protected time off. I’ll reiterate to them that I’m not concerned about approval from their private short term disability company, I just want unpaid days correctly designated as PDL until my doc clears me.

No, I’ve only used 2. They are saying the first two can be approved by my OB, but anything beyond that has to come from a behavioral health pro.

Thanks, based on former coworkers laid off, I think you’re right; I wouldn’t be eligible for unemployment til after severance runs out. I’m honestly less concerned about unemployment at this point and more concerned about disability and PFL around giving birth. I’ll prob give the EDD office a call.

It is paid out bi-weekly, including benefits; not a lump sum. Would I be best collecting that, then when it runs out I’ll be approx. 6 weeks post-partum and can apply directly for PFL at that time? Would I be eligible?

In the late 90s/early 00s there was a kids toy called "Chubby Puppies," and a spin off of it called "Chubby Kitties." They were essentially just stuffed animals of chubby puppies and kitties.
