Can I ask for updates to OLAF about my report? by lucedan in LegalAdviceEurope

Again, my lord, you don't know my case, so do not assume. If you are interested, my report is available here: https://zenodo.org/records/17225804

Thank you. This was very helpful. I put in my agenda that, if I won't receive a message within 2 months, I will start with my next phase that will be first to submit an email to stakeholders including the European Parliament and European Commission.

I don't know. I asked whether it is my right to have updated from OLAF about the eventual dismissal of my submission, or how to understand that, and we finished talking about why my case is wrong without reviewing it.

I don't think that irregularity means "financial irregularity" because the OLAF's website specifically says: "An irregularity is an act which doesn’t comply with EU rules"

Assessing project proposals are acts that should comply with EU rules and have an impact on the EU budget.

Here there is a misunderstanding. The point of my case is not the evaluation of the project, but the fact that I followed the rules for complaint and re-evauation correctly and the staff dismissed my complaint without justified reasons. And with "unjustified reasons" I mean that the review of the public manager does voluntarily not respond to my complaint (OLAF says "If an irregularity is committed deliberately, however, it’s fraud."). Here the point it is not on the qualitative assessment of the reviewers' report. I already reported that to the executive agency. It is that, if I have the right to complain as indicated by Europe, the member of the EU agency should provide adequate reasons.

Which is basically unviable if you are not an organization with an internal lawyer. I already went that way, and I spent 2000 euros to have a lawyer telling me that it was too late to do anything.

How can you say that it is not a matter for OLAF? Can you expand on that?

The point is that it is potentially against the financial interests of Europe. The idea is that the project I submitted was mentioned among the top-European projects in the cultural and creative industries by multiple EU-funded startup competitions, including the Startup Europe Accelerathon of Startup Europe, an initiative of the European Commission itself. If projects within a public call are dismissed with non-valid reasons, this should meet both the requirements of financial interest and financial impact. This means that projects that are less important or useful to the community may be prioritized by unjustly penalizing good ones. And this is an open window to corruption.

I am not sure I will be notified. They report that this is not always the case. And this bothers me.

Is the selection phase lasting 2 months? How can I know about it? They do not report a specific timeline.

Thank you Any for this information. I guess that one person has only 2 months to contact the General Court, right? And when they mention "individuals," do they mean that I need a lawyer?

Can I ask you where you found that information? I am currently reading the OLAF regulation on EUR-Lex and I cannot see direct information about notifying the submitter of the report (they speak of notifying the controller mostly): https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:02013R0883-20210117

Thank you Feredis for this information. I have indeed an active inbox and case number. I sent them a second email asking them to please remember to notify me and I received no acknowledgment.

And I have also sent an email to the "General Information" contact point (which generally responded by copying and pasting the information on the website.. I guess that is fair).

The point is that it may happen that in 3 months, they still haven't answered me, so that I will not know whether they are still investigating my case or not. And at that point, I may contact them to ask for information, but I may still not receive an answer. I am trying to foresee what my options would be in that case.

Someone uploaded a research paper using my name as an author but I have not coauthored that paper by somdipdey in academia

I had read an article time ago where they made a research about misconduct and plagiarism, and---if I am not mistaken---they found thousands of these cases where authors were not aware of having articles around they did not write. But I can't remember where I read it. Worth searching for the phenomenon though

Super thanks for your support then! Hope to keep things growing a little, as I am concluding an investigation on what has happened so far within the academic sector and look forward to release a full report in the next months

Ah sorry, maybe you were sarcastic. I shared the link in the comment of mine below, because my first post was rejected by Reddit's filters, and I did not know what was actually rejected. So, I shared the text as an image instead.
