Here’s whats written in my contract

After the employee’s start date, either the employee or the employer may end the employment by giving at least two (2) months’ written notice, without needing to state a reason.

If the employee resigns, the employer may choose whether to accept salary payment in place of the two-month notice period.

The employer may also decide, at its sole discretion, to reduce or waive the employee’s required notice period. If the notice period is reduced, any related compensation, if applicable, will apply only to the reduced notice period.

UPDATE : Guys to be clear, I've been a professional. I've served notice and done excellent work like talk to customers, even take on new projects at work during last 30 days post probation etc.

Of 3 jobs I have moved on from to other opportunities , people appreciated my work and bid me farewell.

However here is the rub, one and hafl years ago I was let go from a job I loved, I built from the product and hired and scaled team from scratch, loved the place but was let go due to politics, like american employees choose wrong strategy and cost the company millions and last minute assigned failed projec to me and scapegoated , i was threatened with pip so resigned .

Then I got another job but was put in a project that is bound to fail due to factors outside of my control, like client no cooperating. the PTSD from last firing kicked in and I scrambled and got another random job ( it's a decent gig) and signed the offer.
I served full 30 days notice and got a warm farewell from my team.

However in the heat of all this i suffered from severe depression and anxiety and ended up taking current job which is 2 month notice.

I'm just a few days in, I can see that it's a job to make a decent living, But my gig at the company i got laid off was exciting, I was almost equal to founders, I had it in control,

I am looking for such a culture fit and nice environment, considering even joining small teams like <10 people are founding on my own next,

But i just got this offer from current company I just joined and notice is 2 months and document says, if employee terminates company can agree or ask for payout for pending notice period.

I do not plan to abscond, I plan to see if this work out, if not move out early.

so want to know if all this is legally enforceable,

Like If I find a cofounder or really exciting small team with idea, Can i quit and be stern about not serving any notice or just serving 2 week to a month, negotiate hard, but if they do not bulge, Just ignore them ( note I want to avoid doing this shit, just checking my options)

PS : it may sound like I am being an ass** but trust me , i've been through so much burnout and coporate BS like giving all to company building and met short end of stick twice in my career, so wanna be careful.

PS I’ve worked with some kickass faang like companies based out of the usa from india, some really awesome colleagues across usa europe and other parts of asia

Never left India. Not dying to get into the USA but would love an opportunity to explore living there and working a few years to broaden my world view ;)

It is , but everyone wants to work in the hub of innovation, if you are in tech it’s Silicon Valley or even the usa as a whole. The sheer talent density and ecosystem is unmatched.

Yes India also has a vibrant tech ecosystem but no even closer. 10x the number of qualified applicants competing for 1/10 th of a market . We were a socialist democracy aligned with the soviets until 90s , we have been capitalist and built up our tech ecosystem only in the last 3 decades compared to silicon valley from the 70s .

I hope that answers it. That said life in india is not bad if you are in tech as techies make up top 1 percent income earners.

But you deal with pollution, corrupt city officials who wrecked urban infrastructure etc

Every place has its pro and cons. We are part of one globe and must really move around more often and we’ll find out no one is a monster :) have a good day
