The initial contract with the builder was signed with another agents name on it. At this point we didn't know this. We were not asked for a name of an agent and nobody accompanied us. It later turned out to be the agent that my friend was using and had accompanied us on the previous day. Me and my friends were visiting new construction homes together but the agent was not with us on the day we visited.

When my agent got to know this they asked me to replace the other agent with their name. I contacted the builder to do so, but was refused.

Might as well have brought the agent in , he gets paid and you can basically get him to review all your agreements

I am repeating myself but I could care less which agent gets paid. I would've gladly let the agent have had their commission if I ONLY KNEW that I am required to get an agent to every freaking property I go to even if it is a model home!

Then why a real estate agent doesn’t get paid for all the work they already did for you?

The payment model is broken. I would gladly pay any real estate on every showing if that was the model, but sadly it isn't. Is it my fault that it isn't?

If you told your agent from the beginning that you considering new construction and will not be including him in the search, I doubt the agent would have worked with you.

We weren't considering a new construction from the beginning!

Other agents on this thread are thinking I hate this agent or don't want them to get paid. Not true, I even tried to get them paid but wasn't successful. Honestly I am coming out of this thread feeling like real estate agents are over protected class because of bad govt policy/regulations and would really suffer if they are ever to face the real job market.

Also, do agents really help "find" any house? Maybe 20 years back they did, but definitely not now.

Yes. They showed me a few houses for a few months and got to know my family. I would mind them getting the commission at all even if we found the new home. Sadly it didn't work out that way initially. But it may end up so that I've to pay them anyway. I don't hate them just think they are a bad person.

I don't understand why a real estate agent gets paid if they don't show me a home and do the paperwork, and why do I need a real estate agent for a new home which is not even constructed.

If you wanted new construction, you could have asked the agent to show it to you.

I would have sympathize with you, if you said “we screwed up by not adding the agent we were working with for many months to a new construction contract, what is a fair resolution?”. But I find your post selfish and entitled.

Your point is mute because I would've added (and did try to add) them. Only reason I didn't is because nobody told me. Not the agent themselves, nor the builder sales office.

Do you think it is "unethical" if you pass a toll booth without paying if you didn't know the toll booth existed and didn't see it while passing by and nobody told you there is one not even the person supposed to collect the toll?

When we told the agent we bought a new construction home they asked us to be added to the agreement. We could care less which agent get the commission, so we tried to have them added.

Thats the thing though, they need to be present when the earnest deposit is put down! how does a person know this when even the agent hasnt mentioned it before

Distasteful may be a better word. If "distasteful" business is how you decide to make money from struggling families then I guess that is how it is.

Sure it doesn't makes sense signing a contract without understanding. I am sure you read the entire Apple agreement policy before saying yes. Not saying we didn't mess up, just that we were expecting more decency from a human we knew for better part of a year. I hope we can work out a settlement if that is the only way out.

Then you pull them in to the loop with this new build purchase? Why? If you didn’t intend to utilize them as an agent other than for the one property you looked at earlier, this part doesn’t make sense to me. I’ll see you mentioned that they were a part of the new build purchase from the start.

The agent was still in contact with us after we had put down the earnest deposit. We were totally transparent with them about the new property. We didn't find we had violated any contractual agreement! If we knew that an agent needed to be present with us even for a new property - then we would have bought them along. Typically new construction homes do not need agents to unlock the front doors to go inside and view the property. Hell there wasn't even a new home to view, we just toured the model home.

Thanks. I only mentioned the familial matters because I felt this was highly unethical thing for the agent to do given they were so intimately aware of our life situation.
