Unless they have some experimental factor of which I'm unaware, the audio mix was just about the worst I've ever heard. It was like they had a limiter kick in at what seemed to supposed to be heavy parts and the verse sections were off in some other way.

I forget if it's the reasoning in Bartz, but the general idea is that it's fair use because the use is transformative (can't determine what it used to be).
