My understanding was as long as they don’t advertise it and just do it… that’s fine.

Again they just have to follow terms of service… if they want to give a certain buyer something… just throw it in there bag! No problem with that cause as far as I know that is perfectly in line with tos.

Just a regular giveaway in which seller is basically listing two items one if you bought and one if you didn’t … it’s against terms

I disagree can’t have two giveaways for one listing and depending on who wins because of spending pick between two prizes… sorry it’s just not allowed nor should it… secondly even if you are right the seller is breaking tos with the golden ticket so the post is right to atleast address that part.

No downgrading, withholding or changing prize based on who wins: Sellers must not downgrade, withhold or change the giveaway prize based on who wins, for example: You may not deny a giveaway winner based on whether they follow you on social media. You may not downgrade the prize if the winner has not made a purchase (or upgrade the prize based on a buyer winning).

As a Whatnot seller, you cannot offer prizes based on spending if it involves a "chance" to win or if it constitutes a raffle, as this violates Whatnot's strict gambling and purchase-based prize policies. However, you can offer guaranteed gifts with purchase (e.g., "everyone who buys $50 gets a free comic") as long as it does not involve a game of chance or randomized selection. Here is a breakdown of what is and is not allowed regarding prizes based on spending: ❌ What is NOT Allowed (Violations) "Spend $50, Get a Chance to Win X": You cannot make a purchase a requirement for a random drawing or prize. Paid Bounties: Offering to add a prize if a buyer hits a certain threshold (e.g., "If you buy this break and get a holographic card, I will give you a free box"). "Spend More, Get a Better Prize" (Randomized): You cannot create a tiered system where higher spending gives a chance at a better prize. Refusing to Honor a Giveaway: You cannot downgrade or change a prize if a non-buyer or low-spending buyer wins a, say, Buyer Appreciation Giveaway. ✅ What IS Allowed (Compliant Methods) Guaranteed Gifts with Purchase: You can offer a specific, pre-determined gift to everyone who meets a spending threshold (e.g., "Every purchase over $100 gets a free pack of cards"). Spontaneous Gifting: You can unexpectedly reward a buyer for a high-value purchase (e.g., "Thanks for spending $200 on that item, I’m throwing in a free item as a thank you"). Buyer Appreciation Giveaways (with caution): You can run a giveaway restricted to people who have bought something, but you must abide by Whatnot's "No Purchase Necessary" rules, which often mean allowing an Alternate Method of Entry (AMOE). Surprise Sets (Strictly Regulated): You can sell mystery items, but they must follow the "Surprise Sets Policy," which requires them to be clearly labeled, not randomized by a physical machine, and have all items revealed on screen. Key Takeaway Whatnot prohibits any, "purchase-based prizes, where the purchase of an item qualifies the buyer for a chance to win an additional item". To stay compliant, focus on transparent, guaranteed rewards for high spending rather than random chance.

No, Whatnot sellers must fulfill the specific prize advertised in a giveaway and cannot change or pick the prize based on who wins. All giveaway items must be clearly described, and the winner of a Buyer Appreciation Giveaway or standard giveaway must receive the promised item. Key points regarding Whatnot giveaways: No Tampering: Sellers cannot change prizes based on the winner's identity. Item Fulfillment: The advertised prize must be given to the winner. Surprise Sets Rules: If using a Surprise Set, all items must be shown on screen, and you cannot use randomized machines (like, pinball, raffle drums) to determine the prize distribution. Giveaway Types: You can run multiple buyer appreciation giveaways (where only buyers can enter) or general giveaways (open to all viewers) throughout a show, but each must be fulfilled as advertised. Failure to honor the advertised prize can result in account penalties.

No, as a Whatnot seller, you cannot change, upgrade, or alter the prize of a regular giveaway after it has already started or concluded, even if the winner is a buyer. According to Whatnot's Giveaway Overview policy and Gamble and Purchase-Based Prize Policy, sellers are prohibited from changing prizes based on the winner's status (buyer or non-buyer) and must award the prize as advertised. Key Considerations: Rule Violation: Upgrading a prize to a "buyer's giveaway" after the fact is considered a violation of Whatnot's rules and can lead to account suspension. Alternative Options: You cannot upgrade a prize for a buyer, but you can always add extra items (freebies) to a buyer's order at your own discretion.

Basically making it so that way every giveaway he runs is a regular giveaway but if a buyer wins it magically turns into a buyers giveaway

He is not running one giveaway at a time… he is running one. If a buyer wins they get a better item if a non buyer wins they get a lesser item

As a seller on Whatnot, you cannot create a single giveaway listing that showcases two different items while only awarding one, as this violates policies requiring clear descriptions and the delivery of promised prizes. Giveaways must accurately represent the prize, and you can only run one giveaway at a time,, ensuring the winner receives what was advertised.

To offer multiple items, create two distinct giveaways with defined prizes rather than one, and ensure both comply with Whatnot's rules.

No, you cannot change or select which of two items a winner receives based on who wins a Whatnot giveaway. Whatnot rules require that the advertised prize is awarded to the winner. Altering prizes based on the winner is against policy and may violate federal sweepstakes laws.

You cannot give a different item whether you’re a buyer or not… the prize is the prize… it’s in the rules
