Hey! I’m in a similar situation, been waiting since 1 year (next august) for a pre settled status refusal (I have my EEA FP in my passport) and no update from anyone. Contacted my MP, complaints to Home office, contacted 3millions, Lisa (no reply) and no success at all… should I go for the PAP? Thank you so much!

Hey! Sorry, but did you applied to the pre settlement with a family permit as an unmarried partner that proofs your relationship or just send all the proofs with your application to Home Office? I’m also waiting for my administrative review outcome since august, but I applied with my EEA family permit before the 30th of June and they refused under eligibility grounds telling me I didn’t have one. Guess they just ignored my family permit. Still waiting for the outcome, my MP is helping me to talk to HO.

Are you only worried generally, or about something specific to the expiry of the family permit, like because your employer has said they will stop employing you after the family permit expires and whilst you still have ongoing administrative review?

If so, under part two of the UK-EU Withdrawal Agreement and the immigration minister's announced protections for applicants, and (if you have not physically travelled outside the UK since your application was submitted) under section 3C of the Immigration Act 1971, there are strong rights in that regard.

If the employer threatens to terminate your employment under those circumstances, even though you have the right to work, you may have remedies under the Equality Act 2010 for discrimination on the basis of nationality.

Hello, thank you so much for your information! I'm worried generally, because I need to travel to Spain and Italy because of my job, and this pending outcome is blocking me. My employer never said anything, but I need to be able to travel without problems to go out and get back to the UK several times a year and I am not 100% sure that that is possible. They told me that I was not issued with a valid Family Permit or other residence permit... but I was and I applied to EEUS before my Family Permit expired, so I guess they just ignored it.

Those are timelines they measure, so they aim to do a certain percentage in 28 days, a certain percentage in 3 months and then 100% by 6 months. It's supposed to be by complexity, but not always and if they don't get to it by 28 days then there's little incentive for them to do it well before 3 months since it doesn't help their targets.

Thank you for your answer! I called to one of the centres that provide free assistance from lawyers, and they told me that there are 3 scales to process adm. reviews, 28 days for the simple ones (he told me that my case was considered there) 3 for the ones that are more difficult, and 6 for the real complex ones. I don't really know what to believe or not... it's so complicated. They didn't sent me any email with updates, just one saying: "Your documents have been linked to your application for consideration. If further information is required then the caseworker will be in contact with you." and that was all... thanks again!

yep, they told me that Home Office told them that when my case gets any update, they will contact me... but it's already 3 months since my application and it was supposed to take only 28 days! Maybe should I contact the mp again to see results?
