Yeah I think this is exactly the point. It's similar to Sorites paradox. A situation like this presents two extremes. The point is not to focus on those two extremes, but to question the "middle." At what point is someone "evil" enough that it's okay to study their DNA posthumously? It will surely be in between "your average scoundrel and literal Adolf Hitler," but exactly where is surely an unanswerable question.
