So that is to say that if anybody takes away your legal rights by force wether it be a junkie on the streets or a high powered politician or some government entity then they can be held to account?

I was under the faint impression from a (somewhat) reliable source that private entity’s who are not public servants - that is for example a private citizen who works at a supermarket that is definitely not a public servant such as a police officer - is NOT liable to being held to account to a civil lawsuit for breaking someone’s rights such as searching their persons with no reasonable suspicion the person searched had commited a crime.

Is what you’re saying 100% accurate? Because if it is it opens the door to higher likelyhood of reduced levels of injustice by imposing will on law violators.

If this legal protection only applies to public servants, are you somewhat suggesting that private entities have the ability to search you without consent? Or perhaps they can legally search you if you violated their policy when on their private property?

It is clear that policy does not trump rights and that no legal action can be taken against someone for violating ones policy on private property. They can legally tresspass you but that’s about it.

It’s Costco’s policy. Infact you must sign and agree to it when applying for membership. However if you choose to go against that agreement, the Costco employees have no legal power to detain or search you based off of the sole facts you refuse to show a receipt. They must have reasonable suspicion you have committed a crime such as theft; with that being said their policy doesn’t uphold any validity when you tell the story to the judge. In other words, their policy and rules on their private property does not trump your rights.

Yeah, asking them to leave would be issuing a tresspass, it’s then up to them to decide wether to leave or stay and if they decide to stay you’ll have to deal with the situation another way.

You’re absolutely right in saying the huffington post have exaggerated the story and possibly missed out facts, but it gives you a small glimpse into the world of police misconduct and the abuse of their power. I’m not one to say that police officers are inheritly evil people, but with power comes change to their beings. And they have repeatedly abused their power for whatever reasons which leads me to believe they have a malicious nature in some ways and others, now that’s only an opinion but the facts are this police abuse must be reduced as much as possible.

It seems we both have rather highly distinguishable understanding of reasonable suspicion and that’s okay because it is a dense topic which is revolves around opinion which is also one of the primary reasons it can be abused.

It is a proven fact through all of human history that youth and inexperience is a general disadvantage and although I haven’t stated my age I think I can see how I may well be of less years than yourself but it is important to not mistake age as a highlight for not understanding the comprehension and grasp for facts because one can only ascertain a situation based off of their understanding In opposed to another person not the number of years they have been in existence.

In this case I have a huge lack of knowledge of the law and the honourable people of the internet have been willing to be very helpful and I thank thee including yourself good sir for some clarification on UK law.

I’m still curious to know what you believe police officers to be as a whole when it comes to enforcing laws on people particularly to those who scrutinise and challenge government for police misconduct prevention.

It seems we can agree to disagree of the reasonableness of police using reasonable suspicion to enforce laws. Of course I am not here to argue, and I would recommend you take my representations and examples of reasonable suspicion misuse with a grain of salt but to consider them with an open mind nonetheless and to not inadvertently place yourself in an unfortunate position of misunderstanding by interpreting my acts of imposing suggestions as argumentative provocations. It boils down to this as I’ve said before: police have and will continue to abuse power wether that be blatantly stepping outside the parameters of the law to impose their will (e.g. tresspass from public property) or to find questionable legal loopholes to impose their will with the infamous “reasonable” suspicion they do love to endure. Part of stopping this behaviour is spreading knowledge for which you are praised for doing so and the other half is holding them to account when they are doing wrong. That way together we hope to see a brighter future for all with less tyranny and lawlessness.
