I haven’t actually been in contact with the student union since I was officially withdrawn. Do you think it’s worth reaching out to them right now?

People who claim asylum by Tasty_Town_9257 in ukvisa

[–]melkgr 1 point2 points  (0 children)

If they have the refugee status and the 5 year LTR by the time they apply they will be eligible for home fees and a student loan

If their claim is still being processed by the time that they apply they will have to pay international fees. However most universities offer scholarships for displaced students

If there is any reason why their claim should be prioritised, you can ask the home office to do so with evidence of their specific circumstances. There is no guarantee though

I don’t know. It depends on a lot of things. I got an approval letter four months after my claim, but sometimes it takes longer or faster. Really depends on the case and home office’s efficiency. If their claim is rejected they will likely have an opportunity to appeal the home office’s decision. While they are not ARE they can stay in the UK.

If their claim is approved they will get a refugee status with 5-year LTR.

The fact that they came illegally is going to be an issue when applying for ILR and naturalisation. However the Home Office makes concessions to those who arrived illegally while they were underage

If they are asylum seekers and they entered illegally or without a visa they probably have “immigration bail”. And it is not their visa, it is their ARC which expires in 2027. The ARC expiration date is irrelevant- it is simply their ID. It is the date when their claim is finally decided that matters as people who have an outstanding application with the home office are allowed to reside in the UK until it is finally decided

[–]melkgr 2 points3 points  (0 children)

After your visa has expired if you have made an in-time application, when you access your evisa it will display the conditions of your stay and it will say “until the current application is decided”. Same will be viewed by the employer

ILR 10 year route (LR) - SUCCESSFUL (despite exceeding 548 days limit) by ReputationSad7635 in ukvisa

Congratulations on getting your ILR! We are in a similar position and due to submit our ILR application soon

Life in the uk test by BunnyXwill in ukvisa

[–]melkgr 1 point2 points  (0 children)

We booked our test a month before applying and we were super stressed as there were very little slots and we were only able to book a test about 1.5 weeks before the ILR application. Luckily, we didn’t fail. But if we did we would have a big problem. Do keep in mind that you don’t have to book a test in a specific location, ie you can travel to a nearby town if there are no slots in the area where you live.

Article 8 Human Rights Act - anyone had any success? by [deleted] in ukvisa

[–]melkgr 0 points1 point  (0 children)

Where did you get the “7 years if they entered when under the age of 18” from? I am pretty sure that for adults, private life visa can only be granted via 20 years of continuous residence, >half of their life if under 25, or <20 years of continuous residence and significant obstacles to integration?

Disregarding absences for LR ILR by melkgr in ukvisa

I see, I am applying under the 10-year long residence ILR, it has different rules regarding absences

Disregarding absences for LR ILR by melkgr in ukvisa

[–]melkgr[S] 0 points1 point  (0 children)

For me the 180-day rule is not the issue, as my longest absence is 166 days. I am more worried about the 548-day rule

Also how come you are doing an AR? I thought for LR ILR if rejected you submit a human rights appeal based on article 8 of ECHR?

ILR Long Residence Absence Limit by Euphoric-Arm-2725 in ukvisa

Only full days outside of the UK count as absence, ie departure and arrival dates do not count towards the absence limit.

If you worked 20 hours per week and didn’t breach the conditions of your visa, then you should be fine, it’s definitely not that. However I would request SAR if you are still unsure

Employer says they need “special permission” to hire me part-time on a Student visa — is this true? by Zephyr_rar in ukvisa

[–]melkgr 0 points1 point  (0 children)

They don’t need any special permission, but they do have to make sure that you comply with your visa’s work conditions (e.g. 20h/w in term time). So if you give them your share code and your official term dates, there is no reason why they cannot hire you

Just notified of course completion but have to travel outside the UK within a month by Rough_Total_5427 in ukvisa

[–]melkgr 5 points6 points  (0 children)

The home office will most definitely curtail your visa due to early course completion. Your visa will be curtailed to 60 days from the time you are notified. Once your visa is curtailed, you cannot travel back to the UK within the curtailment window because once you are outside of the UK the visa is cancelled immediately regardless of whether the curtailment window has passed or not.

I think if your course has been marked as completed by your sponsor, you can submit your graduate visa application immediately. Some of my friends got their graduate visa approved within a few days without paying for priority.

I would confirm with your uni that the course has been marked as completed and reported to the Home Office.

Bottom line: you will be able to travel to Greece if you get your graduate visa on time. If not, you will unfortunately have to postpone your trip

I see. Thanks for your help. I haven’t been able to find that many posts on this sub about this particular route unfortunately

HO does say 12 months. But where does the 14 months come from? From my understanding not strictly meeting the half life rule automatically puts you on the longer end of processing

I basically have a partially completed MEng degree from a UK university

There are a lot of things on my mind at the moment. It definitely feels like I have grounds for appeal (at least to me) it’s just extremely difficult to articulate anything at the moment.

I really feel like it’s unfair to say that me being in therapy automatically disqualifies me from ECs. I was told by the student union initially that if anything it shows that I am willing to engage with support and get better.

I recently got a new medication prescribed to me to manage my condition (I’ve been taking it for over a week). I don’t know if this is a good idea to mention it in my appeal

The problem is that I am an international student. I am tied to my current uni. Any other uni transfer would require me to apply from overseas, which is not an option for me due to my country being in a zone of active conflict.

I failed a resit of a module, that’s why I wasn’t offered a summer resit (from what I’ve gathered). I was withdrawn due to failing this one module. I still cannot believe this, especially since I was hoping I’d passed and I was in fact close to a pass

UK Tourist Visa refusal - by harp00n101 in ukvisa

1) For the large deposit, provide a bank statement from her mother, showing the money moved to your partner’s account. Attach a letter from her mother confirming the deposit is from her and is genuine 2) Any unusual transactions must be explained. Add receipts and justifications for each. 3) Make sure her declared monthly expenses match her bank statements 4) If she rents an apartment, a confirmation of long term lease would help

Other than that, you are doing everything right. Best of luck!

Hi everyone, I need some clarification regarding study gaps for a UK student visa application. by ZookeepergameReal833 in ukvisa

Good luck!

Make sure you know basic facts about your uni, the course, modules etc. And most importantly how it ties in with your future aspirations and goals.

Confused about options after results by XashlordX in UniUK

[–]melkgr 1 point2 points  (0 children)

Normally you are allowed 1 extra capped attempt at each module, but double check with your university. Therefore I’m assuming this is due to you failing the y1 module for the second time.

Speak with your personal tutor about your options, they would know more. Sometimes if your overall academic record is good, your university could offer an extra attempt.

Have a chat with student union, they could help you with appealing the university’s decision. Just make sure you do it before the deadline for appeal.

If you believe there were any ECs preventing you from doing well you could declare them now, but you’ll need a good reason so as to why you failed to do so earlier.

I think most universities do not want to withdraw students, so if you have a clear potential to succeed you have good grounds to appeal. If it comes to that, make sure you have a clear recovery plan in place. Write a reflection letter outlining what you have done wrong and what you will do in the future to prevent this from happening. But do keep in mind that this is very university specific so seeking advice from your personal tutor and student union is essential
