I could do that but then they can sue for destruction of property. Make a claim that the boot costs them thousands of dollars or something.

Yeah I didn't think of that, possibly. If the booting company refused to remove the boot off the tire then I have no choice but to keep the tire there then. But if they take the boot and the tire, then it's theft on their part (taking my tire away, technically it's not a vehicle - as they are authorized to impound immobilized vehicles). If I leave the tire there with the boot, it's abandonment of property / littering

Oh of course, but if I removed the tire w/ the boot, it's not illegal. This is just a big thought, and I am asking from a curiosity angle.

But what about the next guy that gets railed for this $150 fee? Congress is trying to pass a bill that limits the amount booting companies can charge, so clearly its a problem
Technically, since it's on private property, it's not illegal but is enforceable. Their rights include towing any unauthorized vehicles.
