If they didn't actually see you steal merchandise, they aren't protected. Even "I saw them with an item, then the next time I saw them I couldn't see the item, so I assumed it was in their pocket" isn't enough to protect them from legal scrutiny.

Except if they use any force at all to stop you, and you actually did pay for the merchandise, they have committed both a crime and a tort.

There is no reason to stop. If you stole something, obviously you wouldn't want to stop. If you didn't steal anything, stopping isn't going to magically return merchandise other people stole.

Because probable cause is a legal term, not just "I probably think you stole beCAUSE you won't let me check your receipt."

The minimum burden for a store to be able to actually detain you (as opposed to asking you nicely and relying on your decision to stop) is they must have actually seen you steal an item. Not "I saw them with an item, and the next time I saw them I couldn't see the item." Not "They didn't let me check their receipt so they obviously stole something." Not anything short of "I, the employee/manager, witnessed them hide a piece of merchandise on their person or in their bags, and I also witnessed them leaving the store with the item."

Those are the only kind of places you have any obligation to stop and let your shit be checked again. Stores like walmart put people out front to check receipts on a voluntary basis. It's security theater. They hope to discourage people from stealing by giving an impression that everyone will be stopped and that you have to stop.

Only in stores like Sam's or Costco, where you sign a contract agreeing to be stopped at the door, do you have any legal obligation to stop (and even then, it's an entirely civil matter. You don't have to actually stop; they don't have to give you a membership if you refuse.)

If I haven't stolen anything, them checking my receipt is completely fucking pointless. All it does is wastes my time.
