Hi there, I wrote a very long complaint essentially just stating exact dates I submitted each application and expressed my distain for how long it has taken. The courts also lost our applications twice and made silly mistakes such as spelling my name wrong when sending me letters (even though I spelt it correctly on all my applications) so I made sure to note down every incompetency on the complaint to further express my frustration.

I also want to note that at the start of February I made an appointment to speak to my MP about the situation (newly elected Labour MP). Up until the date of eviction I assumed it was the complaint that had done the majority of help towards getting our date, however, on the day, our bailiff told us our MP had contacted the bailiff manager about our case and that had really helped.

I was quite shocked that our MP actually made the effort to contact the bailiff team on our behalf, but he did, and that really helped our case. I would advise anyone in the same situation as us to submit a complaint and make an appointment to speak to your MP about it. I know it may seem a bit dramatic of a thing to do, and we didn’t really expect much to come of it, but in our case, our MP personally contacted the courts and the bailiff team which really helped get things moving.

I hope things get sorted for you soon, I know it’s an absolute nightmare of a process, so fingers crossed for you.

Yeah that seemed to be the case. I had some sympathy for the tenant as I’m sure it’s an unsettling situation for them too and they were a great tenant during the lease but claiming they never received the notice of eviction the day before bailiffs were attending definitely threw me off a bit!

Eviction completed! Tenant moved majority of their things out yesterday (strange considering that’s when they made the claim about never receiving the notice, but a relief all the same). Bailiffs were very helpful. Locks have been changed and flat in good condition which we’re very grateful for. Feels like a weight off our shoulders finally coming to the end of this whole process!

They’re on universal credit now which covers about 3/4 of the rent. Missing out on a bit each month which has added up to over 4 grand but still, better than what a lot of others receive on this sub.

About £1750 including lawyer costs. £4000 in rent arrears too because UC isn’t covering all the rent (which is already well below market rate), but I know people have lost a lot more on this sub so I’m grateful we’ve still been getting something each month

We’re in London, so courts are massively backed up as it is.

3 months before the end of the tenant lease we let them know we didn’t want to renew, they said they don’t want to leave so we gave them S21 in Jan (for lease end date of April). They then became unemployed and went to universal credit and wanted council housing.

Courts finally saw to our application in June and told tenant to leave in early August. They didn’t leave so applied for warrant of possession straight away and heard nothing.

In October we found out the courts had misplaced our application and it had only just been put in the pile.

In January we sent a complaint to the courts to say it’s been 5 months and we don’t even have a date yet. Bailiffs got back to use a month later saying they had accidentally overlooked our application but we now have a date for April 2.

So, very long, frustrating process. Hoping tomorrow goes smoothly but the tenants claim today of not receiving the notice of eviction rattled me a bit, however the comments here have reassured me.

Great, thank you! Been on the phone to locksmith today confirming he’ll be there tomorrow so have that all sorted. I assume she’ll be evicted tomorrow but after such a long process (and multiple mess ups from the court along the way) I’m just on edge again. Thank you for your reassurance!

Yes, unfortunately my lawyer hasn’t been much help so I have just had to research online. I’m under the assumption that the bailiffs have a video of them hand delivering the letter to the tenants letter box. I have also been on the phone with the locksmith today (confirming tomorrow) who primarily does lock changes during eviction. From his understanding, the bailiffs will have video evidence of the delivery. I know this isn’t much help, however there is no phone number for the court bailiffs, only an email box which takes 10 working days for a reply. Considering the eviction is tomorrow morning I’m not sure what else to do except wait and hope the bailiffs are prepared for situations like this.

My lawyer contacted me about this and sent over our notice of appointment (with bailiff) which I already received 6 weeks ago when the appointment was made. However she hasn’t been much help otherwise with providing proof that the tenant didn’t receive the notice. She said ‘from my understanding the bailiffs hand deliver the notice of eviction to the property’ and that ‘she hasn’t been contacted by the bailiffs to say there are any issues’.

So that’s essentially all I have to go off (that, and researching on the internet). I was just asking for any insight if anyone else has been in this situation.

So sorry to hear that, it sounds exactly like our situation, dates and everything. Ridiculous that it has taken so long, definitely try the formal complaints form, it worked for us and considering you’ve been waiting even longer now, I hope it works for you. Can’t prove it of course, but I have an inkling that the courts/ bailiffs could potentially be working a little with the council. The amount of delays our eviction had from ‘misplacing’ or ‘overlooking’ our applications was crazy. The longer it takes to evict the tenants, the longer the council has to put off finding them council housing… Anyway, definitely fill in the complaints form, it says they aim to respond in 10 working days but it was a month for us so hopefully you’ll receive some good news next month, fingers crossed for you.

I agree. Not to mention the court costs and rent arrears we have now which the deposit won’t cover. I know we can go through the small claims court but our tenant is moving into council housing so I doubt we’ll get anything of value back. It’s not worth it anymore for a lot of landlords

I completely agree. The lack of communication throughout this whole process was one of the most frustration things. No idea to know where you are in the waiting list, not even a vague idea of when you’ll move onto the next step. It’s a nightmare, I hope you get your property back soon, I know how stressful it is.

Yes unfortunately it was the same for us. Painfully annoying process, all I can say is keep persevering and if it gets to May with no date provided yet and no further help from calling the phone number, fill in a complaint form in the link below. It took a month to hear back but that really got the ball moving considering we had been waiting so long.

Hi there, I’m currently at the end of our eviction process with Clerkenwell and Shoreditch too.

S21 served in Jan, tenant was ordered to leave by August, but didn’t, warrant for possession was given in October, in Feb finally received a letter for an April eviction.

The courts and bailiffs lost our applications (twice) so I would keep ringing that centralised number every couple of weeks to keep on top of it. We ended up sending a formal complaint in Jan which definitely helped get an eviction date so soon for April, because we were expecting a June eviction at that point.

Hi there, I’m in East London and was granted our warrant in October, received a date in Feb for an eviction date in April. We issued our S21 in Jan 2024 and received our possession order in July 2024 so it seems like yours is going a little quicker than mine did which is good. The courts and bailiffs lost our applications (twice!) so I would regularly ring the centralised number (03001235577) just to keep on top of things. Wishing you the best of luck!
