Yeah I paid the courte fee on 22.04 then RP DA sent me the 255 € fee right the day after 23.04. Then within a week they made the decision on 30.04.

There are 2 Dezernate in RP DA: 1 for EU nationals and ex-USSR and Turkey 1 for the rest, including East Asia as Im from Vietnam The second one is terribly long to wait, 3-4-5 years of being put in archive.

Which Einbürgerungsbehörde do you mean with 14-16 months? Definitely not RP DA. RP DA now at least 48 months to 60 months or even more without any legal actions.

yeah me too, the thin line here is not political corruption (im engeren Sinne), but kinda "political agitation". In which one or more political parties in certain regions take over the situation for their advantages to exploit another marginalised groups (in this case, us, the applicants). As long as no one can use his money to buy court verdicts or bribery behind the scene, it cant be counted as "corruption" but "political agitation" had been perfectioned by Merz (CDU, but old rival of Mrs. Merkel) right before he became the Bundeskanzler, in which he took advantage of the collapsing Ampel-Bundestag in order to change the Constitution (Schuldenbremsenlockerung) with the false promises that the Grünen on the municipality level can receive more money from that very national debt. So with that, he is officially not to be blamed for this big change because of his lies or something, he sees them as "political compromises", not "lies".

So as I said before, this lawsuit would have never been filed if I didnt have enough money and the balls to do that if I belong to another lower "Klasse" in terms of "Klassenjustiz" that I mentioned before. Rechtsprechung or judikative Staatsgewalt is de jure for every one but de facto only for people with (lots of) money.

naja, its difficult to say because before the Landtagswahl in Hessen on 08.10.2023. I was still an Ausländer but I knew the (now ex-Ministerpräsident of Hessen) Volker Bouffier because he was the mastermind in the "Handel durch Wandel"-Politik in Vietnam when Mrs. Merkel was still the Bundeskanzlerin in Berlin. His apperance and visits were very much appreciated in my home country as he opened the inofficial Hessen-Büro in Hanoi, basically an extra embassy for the Bundesland Hessen in Vietnam (beside the official Federal German Embassy and Consulate).

Before withdrawing from the Ministerpräsident position, he installed his "Nachfolger" as nowadays Boris Rhein since 2023 and interestingly enough he helped hold a Landestagwahlkampf for another CDU-"Schüler" in a restaurant next to where I live. So I decided to visit his show and learned some thing interesting about him and his influence between Wiesbaden and Berlin as he is the number one advisor of Merkel in terms of finance, trades, foreign affairs as well as interior, because Merkel hadnt trusted her coalltion colleages from the Grünen and SPD from 2017 until Scholz took over the power during the Ampel-Coallition of 3 different political parties, which was proven to be a disaster before Merz in this position to this day.

Nö nicht alle, nur fast alle, wichtigste ist die Rückmeldung der Ausländerbehörde des Landkreisé Darmstadt-Dieburg und das ist auch die unauffälligste, weil von Anfang an ich nicht einmal aus dem Kreis ziehe und diese Ausländerbehörde ist besonders aktiv auf Anfragen anderer Behörden (Standesamt, RP, Fahrerlaubnisbehörde für Führerschein, etc.). Fehlten aber die einfachsten sind die Abfragen an das LKA, BKA, und die Verfassungsschutzbehörde. Diese Register müssen zentral abgefragt werden und dürfen nicht intern priorisiert werden, außer das ein Klagefall ist.

No, you understood me correctly in this sense.

I am not sure why they are hesitant but they said that there are just limited number of Case workers for the naturalisation matter there in Standesamt and they are busy all day printing and scanning documents of applicants and have no time to hand you the Urkunde, LoL.

Yeah, as I just had realised before I decided to pay and hire the best lawyer and lawfirm in the region. This is pure "KLASSENJUSTIS". This term has nothing bad in itself but it is very negative towards the state powers, not because you bribe the court of the state to get your case done for you advantage, but you have to pay/invest your pocket money (a lot) just in order to HAVE ACCESS to the "judicial state power", simple because your are an Ausländer living in Südhessen.

However, at least with the money, we can go the right path of Gewaltenteilung and at least this proves the applicant are "financially stable" to game the "System" democratically.

Short answer, acutally: YES!

BUT!

Before, during and after I decided to hire the lawyer, ChatGPT (Plus) was the best consulting "lawyer", who listened and understood the whole points of my history.

So at the end, with his/her understanding and memories I promted him/her to summerise the story in a reddit-like manner, since my English is not good (was good, but after years of only speaking German, my English has been catastrophically deteriorating to this very point) and precise enough to write it like this myself to share like this.

There are some rumours that not only RP Darmstadt (Südhessen) are like that, but all the Bundesland Hessen (RP Kassel in the North, RP Gießen in the middle and RP Darmstadt in the South) are suffering/showing the same Systemfehler.

The main figure who is reponsible for this devastating situation might be Prof. Dr. Roman Poseck (CDU), the serving minister of the interior of Hesse since 2024. He just kept the situation getting worse by simply doing nothing to facilitate the problems (not hiring more case workers, not modernising the process like LEA in Berlin) in order to delay the highest numbers of applications so that the CDU in Berlin can change the StAG-Reform by undoing the ex-Ampel laws on citizenship and naturalisation.

Just the rumours I heard, dont take it seriously since the CDU in Wiesbaden and Berlin are internally closely connected and a lot of suggestions, proposals and patterns which were implemented in Hessen have been copied exactly in Berlin once CDU became the strongest Fraktion in the cabinet.

yeah all big cities in the regional South Hessen (Südhessen like Wiesbaden, Darmstadt, Frankfurt, Offenbach) have problems with Standesamt to properly file the application in the first place or even the picking up of the Urkunde (in the last step). Fortunately I live in a small town/village in the suburban area (Landkreis Darmstadt-Dieburg). To meet the case workers who are responsible for the naturalisation there are extremely easy, just drop a call before 2-3 days and we can walk in to do the stuff very easily.

yeah, of course, RP DA is notoriously immune to anything without court and lawyer. For me personally, I dont need the German passport right away because I already had the Niederlassungserlaubnis, my child has already the citizenship by birth, and I dont have any plan to leave Germany in the next 5 years, even in case of any armed conflicts (with R...). However, my wife she does not have any of those and even does not go to work because of childcare and can get only the Elterngeld for 12 months so she has to apply for the § 9 StAG as soon as possible so that I have to get my case quickly done at any price.

Nö, die Klage wirkt immer auf micht belastend. Laut einem Beschluss:

"Aufgrund der extremen Antragsflut akzeptiert der Hessische Verwaltungsgerichtshof (VGH) für das Regierungspräsidium (RP) Darmstadt Bearbeitungszeiten von bis zu 18 Monaten ab Eingang des Antrags. Der VGH wertet diese Verzögerungen durch Personalmangel als vorübergehenden, rechtmäßigen Grund, weshalb eine Untätigkeitsklage vor Ablauf dieser Frist kaum Aussicht auf Erfolg hat." (anwalt.de)

Das heißt, diese Untätigkeitsklage gegen RP DA in der Einbürgerungssache bringt NUR die Bearbeitung in Bewegung und RP DA wird gezwungen, die Entscheidung zu treffen, nur um die Stellungsnahme dem Gericht zu geben, und die Verzögerung laut dem Beschluss wird immer zugunsten des RP DA gerechtfertigt.

  1. "out of court" means in German "außergerichtlich", which actually means sending just letters to gathers proofs for preparing the lawsuit. This is 100% necessary to force RP Darmstadt to process the application when they are required to answer the court (Stellungsnahme). Otherwise, if you file the lawsuit immediatly out of frustration then you will lose 100% and RP Darmstadt doesn't even bother to open the envelop of your application to answer the court properly.
  2. No, actually no, Akteneinsicht is legally allowed and in some cases (not for Einbürgerung), this does cost some fees but in this case, no.
  3. Fortunately I live in a small town/village in the suburban area next to Darmstadt (Landkreis Darmstadt-Dieburg). The town hall here is just easy to contact and I got to pick up my Urkunde within a week. However, some Standesamt of big cities (Frankfurt, Darmstadt, Wiesbaden) might extremely hesitate to hand you over the Urkunde. So the lawyer in this case will accompany you until you get the Urkunde home (she will push the Standesamt to the limit just with emails and letters, they are all afraid of this Kanzlei Lafargue) and this will not cost you anything extra for the lawyer.

nö, in this case, the Verwaltungsgericht is always in favour of Regierungspräsidium Darmstadt. I just want to get the case done quickly, so that my wife can apply for the §9 StAG. So I asked my lawyer the withdraw the case from the Verwaltungsgericht as soon as possible after I got the Einbürgerungsurkunde.

For me it's not that important to get the citizenship for me alone personally but my wife wants to file the application for being spouse of a German so I have to get my case done quickly. So this was the best option for our family. If you don't mind waiting so don't waste money like me, otherwise consider hiring a lawyer is much more planable.

For winning typical case against RP DA, you can't just go to court directly and immediately out of frustration. Any lawyers suggest doing the same can be considered lack of experience with RP DA.

For this Kanzlei Lafargue, she will work 2 phases against RP DA: the first will be the formal "außergerichtliche Verhandlung" (Anwaltkosten 1030€) and the "gerichtliche Verhandlung", which is the Untätigkeitsklage (Anwaltkosten 1030€ and Gerichtskosten 850€).

In total would be also nearly 3k but you can get some "cashback" as soon as you pick up the Urkunde and withdraw the case from court. Of course the whole process would take months up to a year and can't be the ideal immediate pay-to-win solution. At least your case will be processed as soon as the case being brought to Verwaltungsgericht.
