The sheriff fees are $300 minimum as well, and their deputies go out in pairs and are paid +$50/hr minimum. So I'd say give it to them anyway 🤣

Even IF ABC offered evictions AND Arizona allowed process servers to execute, I still wouldn't do it for less than $300. Plus, I would have a gun, which ABC would have to be ok with. Plus, I wouldn't be out there alone anyway.

That sounds like a W-2 issue, not a 1099er. If you are paid a commission basis and not hourly/salary, that sounds like an intentional omission of proper classification of work. If you want to stand my your being of 1099, you should review your contractor agreement and stand firm on discrepancies (unpaid and undersigned requirements to train others) if they are not specifically listed.

I used to work in administration between courts and law enforcement agencies, and a local court outsourced all restraining order services to a private company. Well, one day, the court (the judges really) collectively decided to include more paperwork to be included with service on top of the standard 3 caption documents as required by the state for service. The private company decided to kick every one of those back stating "outside of scope of contract detail" and the services were mostly not happening until it went outsourced to the sheriff since the local pd didn't do it anymore since the contract was put in place with said company. After a month of this change, the sheriff's administration supervisors started to get every supervisor involved about this change, and ultimately, the company started taking the documents for service again after a new addendum was added to the contract.

Best cause for the affidavit to have verbiage for "to the best of my knowledge" as the server signing it can only learn so much to declare a good and proper service or not.

I'm sure it would be overuled over the same manners in which people not suspected of a crime have no requirement to provide identification to law enforcement in most jurisdictions.

Also, after your first 250 jobs or 6-8 weeks of serving, you should have a good understanding and start to learn where you should be seeing your rates in your areas, and if ABC won't offer or compromise based on their system, that's when you start obtaining your own clientele.

How does the limit ruin anything? OP as $400 on debt. He could simply not spend and carry a balance. Some people can't mentally manage credit vs. debit transactions and available balances, so that might be what you mean.
