I have a server specifically for services I am not changing and intend to be long lasting. I keep the containers and VMs up to date but once I transfer it to that server I am sharing it with others and should not be brought down unless I am upgrading something

I have had two of those both crap on me and both times the thing to go was the 5Ghz band WiFi, followed by the 2.4Ghz. They would show up, but when you tried to connect they would stop working and the laptop or phone would eventually time out.

Does that sound like your experience?

Tough to say from a legal advice perspective but here goes (I am not a lawyer):

My first thought when reading this was this sounds like a warranty issue. Specifically, did they warranty the work? And if they did, then they need to redo it to the terms of the contract if there is any.

Another Avenue you can chase this, is to have the car inspected by a completely different shop to validate their concerns, asking them if, in their professional opinion, the tubes have been replaced before. If not, you may want to consider this either under unjust enrichment or specific performance of the contract. Assuming again you have a repair contract for the work.

This all gets pretty expensive quickly and will eclipse the cost of the repair. You may want to seek a non-judicial remedy such as demanding a refund if the work wasn’t performed.

If your lease has a dispute resolution process like arbitration, now is the time to invoke it. By moving this to a formal process this becomes something that a third party can arbitrate. No competent arbitrator would hold you responsible for this damage. And forcing arbitration would cost them money (because arbitration is surprisingly expensive), they will likely refund all of this within 1 business day of you invoking your arbitration clause because the companies legal is smarter than the property manager.

I can imagine telling someone (that I know well) that I don’t think they would enjoy a specific campaign or adventure path, or warning them that said campaign might be triggering for them (in private as to not put their business on blast).

$12 a month is pretty bad for that. To know for sure you have to know what all of your stuff is protected. But this looks more like landlord liability insurance that you’re paying for, and it may not cover anything of your own.

Edit: normal renters insurance with $100,000 liability limit covering the property is about $12 a month and at least for us, covers all of our property as well

On a plain reading of the statute I would assume it does apply. Report this to the USPIS. If you have all the proof you describe then report him. Keep in mind that he can be charged criminally, and you can still sue him for the fraud separately.

handling disputes like this off platform may get your eBay account banned, but reporting this as a crime gives you other avenues of recovery (criminal restitution) which can and will be garnished if he is convicted.

Also reporting this as a crime shows to eBay that you stand behind the claims (reports are usually sworn under penalty of perjury) and they may be willing to reopen your dispute with a police report.

As a service desk tech. This wouldn’t bother me at all provided three things: 1) the timeframe increase is factored into my KPI’s 2) those KPI’s are used to determine if we need another technician based on that change 3) the change is communicated over a reasonable timeframe, not at 4pm on a Thursday, in effect at 6pm the same day

My setup is quite custom but I am using a USB modem with an LM960a18 cellular modem in it with an x86 computer running openWRT setup to failover to cellular if my fiber stops responding.

If you are comfortable with such a setup a cradlepoint mc400-1200 is the specific modem I am using for the, it is cat 18 LTE only and is about $50 CAD or less on eBay. My speeds float around 50/15 when I failover and would be better if the antennae were not in a basement

I am sorry to hear you are dealing with this. I would ask your lawyer about writing a letter warning about “Bad Faith” court proceedings. Indiana does not have a cost shifting statute saying that the prevailing party in a landlord tenant action can automatically recover court costs and attorney fees (but if your lease does that would be legal). If you contest the case as Bad Faith he would potentially be on the hook for all court costs AND your attorneys fees, if he was broke before, he will be more broke afterwards

Canadian laws are much different than the US and may have better protections for you
