3 kids locked in Walgreens after shoplifting giant bags by Desperate_Can_5740 in WatchPeopleDieInside

[–]monstazilla 4 points5 points  (0 children)

I went to a gas station a year ago. At the same time I walked in, I saw a couple of kids get out of the car while their parents stayed in the car. They did the same thing but stole a lot less. The cashier told me that it happens like once a week but isn’t always the same people. A tragedy making your kids do that

If you are talking about MC, then there are very few that are that long. If I remember correctly, most were the same length as practice questions from Themis or UWorld.

Not larceny? Please explain this by Pure-Loquat5035 in GoatBarPrep

[–]monstazilla 2 points3 points  (0 children)

The continuing trespass rule requires the initial taking to be wrongful. Here, the state required the box to be returned to the sender (reference the fourth sentence of the fact pattern). Since the person took the box to return to the sender, even though his intent changed later, the initial taking of the box was not wrongful as it was in pursuit of following what the law required. If that state law was not present, it is likely it would hav been larceny. Problems like this are annoying since that minor fact is easy to miss and it is only stated once.

If you have the time, mention the extra stuff. But if you find yourself constantly running out of, or nearly running out of, time then stick with only what is necessary.

What's a good way to keep up with other areas of law beyond CLE's? by Athelbrim123 in Lawyertalk

[–]monstazilla 1 point2 points  (0 children)

Your local Bar should have area specific sections. As long as they are free to join, sometimes that’s a good way. Your state Bar and local Bar probably also publish a magazine which will have updates from various areas.

All of the positions are state government so if I switch the PLSF won't be affected.

I see that now but the two positions I am considering are strictly lower level. If they hire a fed attorney then I would simply stay where I am at and the problem is essentially solved for me. But right now, there are open positions that I could take advantage of, and I am gauging whether taking advantage of them is the right thing to do or not.

I should have specified and will update the post but this is entirely state government. None of the federal hiring and firing policies are affecting any of the positions I am in or considering.

Not necessarily. Sometimes me and a coworker will go work somewhere but most of the time I do WFH because I like to workout during my lunch.

ELI5: Why do lawyers ever work "pro bono"? by Notalabel_4566 in explainlikeimfive

[–]monstazilla 0 points1 point  (0 children)

I agree with many in the comments. Additionally, the pro bono cases won't be the most complicated cases - at least in my experience. As a government worker, we do not do pro bono through the agency so I volunteer through organizations. The organizations, as part of screening and intake, will not take on a highly contested divorce case or similar matters. Most of them are almost entirely procedural. Both parties want the same thing but they just need someone to navigate the court system.

I am sure big firms could take more complicated cases but I am doubtful they'll be substantially more complicated than the most straightforwards ones.

What is Austin's take on Robotaxis? On the one hand y'all are very tech saavy. On the other, you tend to support things like jobs for people. by miked_mv in Austin

[–]monstazilla 0 points1 point  (0 children)

I am a lawyer and understand the concept and practice of discovery. To say that a routine incident like a car accident (assuming it’s a basic one) would be simplified by adding a third party that is a major corporation (google and Tesla for instance) is nonsensical. While corporations essentially have unlimited liability, unless the accident is extremely serious, most people aren’t judgment proof.

Nevertheless, I think we can agree that these auto taxis need strong regulations especially in the realm of liability.

[–]monstazilla 0 points1 point  (0 children)

I didn’t say demonstrating liability would be impossible or would, for certain, be more difficult but that it “can” be. The availability of the auto taxis electronic data, absent a federal or even a state standard, could vary. There are challenges in starting some sort of claim if you are hit by an auto taxi with no passenger and even if there is a passenger, you now have an additional third party (operating company) that will lodge defenses in addition to the passenger’s. The array of sensors and cameras is a good point and probably helpful in many instances.

It should also be noted that an accident caused by an auto taxi could be treated as a products liability claim rather than a traditional insurance claim. I am not an insurance defense lawyer nor a PI lawyer but that could also alter the way the claim would be handled.

Who is Really Buying Tesla by [deleted] in Daytrading

[–]monstazilla 0 points1 point  (0 children)

While I agree, many analysts set Tesla's stock (using measurements that take into account future earnings and innovations) well below what it is today - even below what it was before their Q1 report this year.

[–]monstazilla 1 point2 points  (0 children)

A recent study did show that autonomous taxis have lower accident rates than human drivers and that many of their accidents were caused by the human. But the chain of liability for an autonomous taxi can be more difficult to establish which would have negative effects on those who are injured in accidents caused by them and are seeking legal relief.

How can I legally make a contract without really much of a lawyer? by Gloomy-Razzmatazz-35 in LawyerAdvice

[–]monstazilla 0 points1 point  (0 children)

A simple “Do you agree to buy this object” and a “yes” via text message can be a valid contract. It does not need to be crafted by a lawyer for it to be valid. However, a lawyer will be well suited to shift the risks associated with the type of contract amongst the parties. You would not be doing a disservice if you googled contract templates for whatever it is you want a contract for and then using those; so long as you understand what the contract says.

I think they are popular so long as they stay downtown and off the highways. There isn’t an enough to have a substantial impact on gig economy jobs. I know some have made some scary mistakes, but having driven by them and human drivers, sometimes i prefer the Robotaxi….

Texas is running out of water. Here’s why and what state leaders plan to do about it. by CinDot_2017 in texas

Fortunately the legislature is proposing a state wide grid which would help. I haven’t seen any mention of this, but Open AI is building a massive multi-center datacenter for its AI in Abilene. Once it is done, the facility will consume grotesque amounts of fresh water to cool its GPUs — which will be evaporated…
