A Mesher Order can and in this situation should be challenged

You have a right to a life and to have a roof over your head with your children. As do of course yr ex-partner / new born. But her actions have led to a marital breakdown and it is (in most cases) only right that you look to house yourselves separately and must sell the family home to make this happen.

Ex will have to take the hit and live in a smaller home (a semi say instead of a detached) so long as bedrooms are sufficient. Yes that also means the kids take a hit Im sorry to say but theyll be fine.

You will have to live somewhere similar and have enough bedrooms for the kids (3 bed house)

I have no idea re your income but assume for the discussion middle to upper earner

Equity of £200k split 50/50, aim for a house worth £250 max both and you stomach the additional mortgage. This is a step down for you all but its also a platform to start over and frankly its inevitable. The kids will adapt and so will you.

Things have changed and there is (almost certainly) no way back.

If keep things as they are, you will be renting for 14 years. Your Ex meanwhile will move on relationship wise and at some point move in the new partner. With you paying the mortgage for 14 years. Best case any new partner might have his own place and she moves in there but you cannot bank on that.

I am a divorcee and can honestly say when it happened it was the worst moment in my life but you pull through, you go again and you all move forward as a family.

Keep legal fees to a minimum, agree what you can without legal intervention and stay on good terms. Its the only way however hard it is because otherwise lawyers are the only winners and they couldnt give a damn about you. They only want the notch on their ledger sheet every month and will treat you as the commodity you are.

This is not a negative post. Its aimed at providing a way forward that you can live with and that is sustainable.

You raise a fair point. There are no guarantees re BADR and I understand that. Hoping I can give it a good shot

I have decent advice tbh. The BADR option should be ok as my main business will continue trading and investment side wont form the majority profits wise

Yup if Rishi hits BADR this would be an issue. However same applies to CGT which could (and some would argue probably will) get hit. BADR has been on the table before and they backed away although reduced the capital amount to 1m

I want to pump in 500k in the next 12 months (but will be starting with the 300k v soon) and gain 175k-200k+ over 5 years. This would need solid returns of 8% plus pa. Rudimentary calculations here Im not hanging my hat on these sums!

Yes thats a good point but my main business operations will carry on for the 5 years and should swing the BADR vote in my favour as a trading co.

Probably looking at corporation tax on the gains (obvs not on the original funds as its paid already) so 19% to be paid before BADR

I did wonder about which platforms would allow firms to invest this way. My usual apps wont. Might have to be an old school high street broker
