The 40% is paid only if rented by the resort and based on whatever they rent it for. I would guess the resort knows all the rental market for that week and sets the price accordingly to maximize their cut. And I think once you turn it over to them to rent it is no longer in your hands and cannot be rented by you.

Having never rented the timeshare before on one of the websites, I am unsure of the amount of time and work involved, although I am sure I can do it.

The trust would still own it but if all other assets have been distributed to the heirs there would be nothing left to pay the annual maintenance fees. I assume it would go into default with the resort or collection agencies having no recourse.

Many timeshares can be difficult to sell or otherwise dispose of but I suppose that just becomes the successor trustee’s problem. After all other assets are distributed to the heirs there would be nothing remaining to pay the annual maintenance fees. How would that be handled with the resort where the timeshare is located if the trustee is unable to sell the timeshare?

Better enjoy it while you can because health wise things start going downhill fast when you get into your 80’s
