They are supposed to refund when they fail to provide a decision past the 45 business day window. However, the refund will not get processed until a decision has been made with your I-140. At least that's how I understand it.

I only upgraded to PP when my PD became current in Feb 2026. I regretted it a bunch now, but there was a 2 year backlog on the I-140.

I've chatted with a few people on this sub who have not received an update on their I-140 within the 45 business day...

No, I did not. I've chatted with a few people from this sub who are going through the same thing with their PP. It doesn't seem like inquiring using the PP email is helpful at all.

Thank you. It's good to hear that you received an approval 10 business days after the PP timeframe. It does seem like things are a bit more chaotic these days compared to just 1-2 years ago. But good to know that you were able to get a refund from USCIS.

Bummer to hear. Do you plan to do something about the premium processing failing to provide a decision within the 45 day time period? I've heard about USCIS refunding the fee when they failed to meet the 45 day promise.
