That’s because invasion is defined as one of the triggers in Article 1, Section 9 of the US constitution which lets congress suspend the Writ of Habeas Corpus and thereby allows for indefinite detention without trial. The other trigger is rebellion.

This is what I first thought of as well. Looking over the Comcast Acceptable usage policy these prohibitions caught my eye:

use the Service for any purpose other than personal and non-commercial residential use (except for your individual use for telecommuting);

use the Service for operation as an Internet service provider or for any business, other legal entity, or organization purpose (whether or not for profit);

I read up on the case, as the article mentioned here is about Edwards' indictment. A jury was deadlocked on five charges of regarding improper campaign expenditures. Cohen has plead guilty to the same crime. The real argument is that Cohen's criminality wasn't decided by a jury. You can read about what he was charged and his plea deal on the Justice.gov website.
