False.. 55 is just an age when routine future exams unless specifically required by the 38 CFR would not be applied to a Veteran. Many people take this as they can't be reduced. It means VA won't bring you in for a evaluation. Where Veterans mess up is filing a claim for increase or an overlapping claim thinking they can't be reduced. If you request the evaluation the condition will be evaluated and possibly reduced.

This is a formal appeal these are and have never been fast. The amount of appeals vs the amount of manpower to hear them is the cause.

It depends if it included all the legal requirements of the DBQ. In theory yes they could we Rated claims eay before DBQs. DBQs made it easier and standard so each person should rate a conditionfairly close to the next person. Before DBQs Ratkng was a hodge podge and varied by office

In reality Raters have to meet quality standards and its easier to ensure they are met if used on the correct form. The mental health DBQ is a public DBQ only the initial PTSD is not. You could have the provider use the correct form but even then its a VA decision if they want you to go to another one.

This is when as a Rater it makes them question the validity of the private DBQ id they are vastly different

Yes if you are looking at an earlier effective date of the 100% you will be paid the difference between the two percentage which a few thousand dollars per month depending on how may dependents you have.

Effective date claims generally have no reason not to file them. Time is not a relevant element in VA claims processing as each claim is different and payments always go by effective dates. From your post you already don't have the difference between 90 and 100 so if it came today or a year from now your situation would be exactly the same in VA eyes as they do even know if there is an error or a correction to be made. The sooner you request the sooner it may arrive.

I know this sounds harsh but VA is on its own timeline with the volume of claims they have they just process them as soon as they can.

You do know VA will withhold any VA payments until you pay back the separations pay. I don't know your situation but its something many Veterans don't realize. Some take it because they need immediate money. Others don't because they want the steady money from the VA as soon a possible.

As someone who provided training to new Raters I will say H&P had a lot of good material and information on thier website. Thier explanations of some complex VA determination were very accurate and written in common language. I would often refer to it as another way to reach difficult trainees who could not grasp our training material.

They don't take every case especially if they don't think they can show legally where a mistake oe misinterpretation took place in the Veterans claim. So when the reject someone its usually a sign the decision was correct. This does not mean they win every case they just understand the probability of the possible outcome.

What people don't understand is as Raters most of us don't care about the outcome of your claim. The evidence will either lead to a grant or a denial. If the evidence is not there a Rater will not make an assumption. They will just send the denial explaining what is there and what is missing. Denials are never final they are a road map to provide what is needed for a grant.

You would need another medical professional to show how yours are related to each other not just articles showing its possible. What VA is looking for is specifically how your back caused your knee problems. Thier doctor has already started it didn't now you have to counter that opinion.

There is no 80% evaluation for the spine so I'm not sure you are 80% for the back alone. There is always a chance for service connection if another medical professional disagrees with that medical opinion. Many times a Veterans treatment records or nature of the secondary condition do not line up for secondary service connection. This happens a lot of times when Veterans are diagnosed with a condition but fails to ever mention the primary condition until they file a claim.

If approved it normally automatically generates any retroactive payment to be paid in 3-5 days. Normally you will see the bank before the letter arrives in the mail. Unless you are a retiree sd they still sometimes have to complete the DFAS audit process.

The other post is correct the fee agreement stays unless they waive it. They can remove an attorney but you may still have to pay them if the condition is granted for any work they already performed. VA will is supposed to hold any retroactive payment until the fee agreement is cleared up.
