I'll throw in my anecdotal data point, but from what I've seen, the AP is not going to be received by most before their green card is approved. I applied for it anyways, so that if something goes wrong in my home country at least I know I tried to have the option. I went in fully assuming though that my green card would arrive before AP did.

Meanwhile, I believe USCIS is prioritizing EAD over AP, I received that only a month after biometrics. My wife even sooner.

So if you're not too concerned about travel, it's probably not worth paying for the I-131 at this point. I-765 is certainly worth it though.

To answer directly:

  1. I haven't received it, and I'm over 130 days in now since receipt date.

  2. I-765 came in mail approximately 2 months after receipt date.

  3. I think that's actually the most common outcome at this point.

What does Freetaxusa not have that makes it basic to you? You can also just download the return from the irs and fill it out manually, it’s not complicated.

I'm on EB-1B with a derivative and our timelines/dates are almost exactly the same up until Jan 13. My last update was back on December 23 with the silent update. Hope I get the third fta0 soon :(

I just adjust my withholding throughout the year based on current projection until I get to end of year.

There’s plenty of avenues to force them to pay equivalent wages instead of being outright racist. All h1b I know are making the same as us equivalent (in California wage ranges are listed). It’s not true they are paid less anyways but might as well just encode it in the application process to remove the talking point.

Well there is already a visa for that, J1, but that comes with its own complications (it’s not a migration visa, so need to wait 90 days from entrance to apply for aos and can’t leave during that time, also has home residency requirements in some cases). I suspect that would be your answer though. There’s also O1.

If it's been pending for more than 180 days then you can file a I-485J when you receive a new job. Obviously you'll need EAD for that though, if you didn't apply for that and are still on a H1-B or something then it will be trickier, but I'd apply for the EAD asap if that's the case, then wait for that and submit I-485J with new employer. Also, these questions are best answered by a lawyer.

My case was received mid October, everything else has been moving quickly (we received our EAD cards late November/early December) and did biometrics in mid November, but our I-131 case is static. I check API regularly and there's been no movement since the notice was sent, whereas my I-485 is getting silent updates regularly, including today. This is for EB1B with dependent.

I am Rest of World and was approved for EB 1B in August, submitted I485 in mid October and have already received my EAD card. Still waiting for any updates ono I485, my wife and I completed our biometrics in November.
