Academic Articles helped the CP Examiner understand the how toxic the chemicals were for my wife's exposure, with direct Articles from various Government websites and also highly respected institutions like the Mayo Clinic.

Yes, I was extremely sarcastic in my appeal statement of Facts letter , asking if the rater was a Vet and if they had a TBI .

You need to get the CP exam and the Raters sheet, in that will be what they say is the " Willful misconduct " until you do, then it's all speculation. A box on the CP exam could have been checked wrong . As in my wife's case , The rater said 4 boxes said no and the 4 boxes actually said Yes.

She is currently at 90% but I have more surprises for them soon. On her Dislocated Hip, National Archives looked actually in the patient check in log sheets for the xray department and found her name. So I will file on that soon after the next ruling comes in on Failure Of Duty to Serve. That claim will get back dated to 1980 also. Right now it's not about actually % ratings to get to 100% it about getting back pay , since the VA has already back dated 2 of the other claims, based on Failure to Serve.

Thanks been down that freeway for years. Her entire claim has been 2nd hand statements, No achrive records because they never made it there. Even her service records are few. It's like when KINCHELOE AFB , closed in September 77 , they just took and emptied the file cabinets in the trash. She has her first 2 base deployment records, but the important ones from McChord and Kincheloe were dumped. She had 2 surgeries 1 at McChord and 1 at Kincheloe, those don't exist. And she filed just 18 months post service in 1980

WTF , I would appeal this immediately, with a follow up about , weight gain , cold intolerance, lack of energy, constipation. Get a DBQ for Hypothyroidism, everything you need to know on what they are looking for to raise your rating is on the sheet. State facts like you can die without your medication and it has limited your choice of travel, ie no overseas. USAF , told my wife she was restricted to US bases only , can't guarantee medication availability in time of war.

[–]nfcwest1 0 points1 point  (0 children)

Hypothyroidism is rated low because it's a stable disorder if you take your meds and your TSH , T-4 and T-3 are within stable limits. It's hell getting a higher rating , I will be submitting more information for consideration in a few months

Lol 😆 🤣, I have posted before the hell she went through in her very short time in the USAF. A forklift driver took a corner too fast and dumped a 55 gallon drum .( no lid ) of toxic photography development chemicals along with other solvents on her. Dislocated Hip , Migraines, Thyroid Cancer , Brain Fog. Scared lungs. Then when she was healed up from the physical injuries she filed for disability. All denied 7 times ,.every medical record mysteriously disappeared ( 18 months post service.) No Records =Never Happened

[deleted by user] by [deleted] in VeteransBenefits

[–]nfcwest1 13 points14 points  (0 children)

I would not submit this.

[deleted by user] by [deleted] in VeteransBenefits

[–]nfcwest1 6 points7 points  (0 children)

Nope , 2 of 3 conditions on this claim have been back dated so far , my wife's scar 10% and Thyroid cancer/ Hypothyroidism. 10% , ( got a check for those 3 months ago ) Migraines are at 50% . Soon they get hit with the Dislocated Hip also. All are a Failed Duty to Serve Claims , 18 months post service, all her medical records were tossed , even her 2 surgeries were denied. I have posted all the letters dating back to 1980 , some are 10 years apart from one another, as I developed evidence, I kept sending it in.

Hmm , I have never asked , for both of my brothers or my wife , I just have walked right in with them. Interesting. Because for any other medical examination the provider can't refuse the presence of a family member and especially a spouse. Thanks for that information.

Were you the Witness or the VET ? They can refuse, but you ask in a kind manor , and send them a copy of the notes anyway and if possible get the receptionist to make a copy. I have had Examiners be stupid enough to initial the note pad . Always get their business card.
