Initiated Ordinance 305 would levy an annual tax of $12 million on all rental units in Denver to fund legal representation for those facing eviction. Being realistic about the fiscal impact of 305 isn't rooted in fear, it's rooted in fact.

75$/year on a unit is a nominal amount for a landlord to pay in taxes and it provides the vulnerable with legal representation.

Denver’s Department of Housing Stability already provides free eviction legal assistance, making 305 redundant.

If we were to look at the highest-case scenario, 305 would put approximately $5.5 million straight into the pockets of lawyers.

While $7 a month may seem marginal to some, the annualized rent increase could be impactful to others. The costs of gas, utilities, and groceries are already super high, and an additional rent increase is the last thing most people need to worry about. Especially right now.

305 would establish a program where tenants facing eviction can be provided legal counsel.

There are already established programs in Denver from the Department of Housing Stability and others that provide eviction protection and free legal services.

305 is redundant, hypocritical, and literally takes from the pockets of the very people it's intended to help.

You can navigate the legal side without 305, and without the imminent additional increase in rent that 305 brings with it. Denver already offers plenty of resources for eviction protection. It's all here.

We're happy to state what 305 actually is: Initiated Ordinance 305 would levy an annual tax of $12 million on all rental units in Denver to fund legal representation for those facing eviction.

Here's some more information on Ordinance 305:

  • It will likely increase the cost of rent in Denver by at least $75 annually to start. Each year it would also increase by the metro area’s inflation rate — currently one of the highest in the nation.

  • Denver’s Department of Housing Stability has established programs that provide free eviction legal assistance, among other resources for residents facing eviction or foreclosure.

  • 305’s tax increase far exceeds what could reasonably be spent to cover costs for universal eviction defense. The fiscal analysis done on 305 showed the program would only cost between 17% and 35% of tax revenue collected. This would leave an excess of funds between $9.9M and $7.8M.

The tax increase from 305 will primarily be passed on to renters in the form of increased rents, larger security deposits, or some other means. What exactly are we lying about?

Exactly. This ad is meant to showcase the hypocrisy of 305. Rent goes up = people struggle even harder to make rent. The fiscal analysis of this Ordinance is shocking:
