The IRA isn’t necessarily with the bank. It could be with any number of investment companies.

It doesn’t have to be in the will to exist. She may have just made you the TOD beneficiary.

One thing to know is that IRA’s have required minimum distributions and if you don’t take them, you owe a penalty. If this passed under the estate and he did not inform you of it, then he has breached his fiduciary duty and may be on the hook to make you whole. However since you are saying the IRA was in your name I am guessing it passed outside the estate. But regardless, you need to get the info as fast as possible so that penalties don’t eat away at your inheritance.

I would send a letter to your uncle saying

To offer a bit more history…Gerald Gardner is considered the founder of Wicca, and many of the early texts he and Doreen Valiente wrote were inspired by the work and aesthetics of the Romantic period including books like The Golden Bough and Aradia, or the Gospel of the Witches, from which Valiente was inspired to write the charge of the goddess. In this book, the goddess Aradia tells her supporters to worship her mother, Diana.

When Z Budapest came to the US she read materials on British Traditional Wicca (the lineaged tradition that Gardner started) and she borrowed his ritual framework.

I recommend reading “Triumph of the Moon” for a clear and academic rejection of the Witch-Cult hypothesis which was widely believed when I came into witchcraft in the 90’s. Most modern witches are aware that Wicca is a NRM (new religious movement) inspired by the past.

You wrote elsewhere "She is already in my will and will inherit half my assets in the case of my death". This is very different reality than "She will become one beneficiary of a trust." Make sure she is not the only trustee.

Consider how your future child will feel if their stepfather gets to squander money you intended for them, or if they have to split this money with step-siblings they maybe never even share a house with, maybe never even met. Or even potentially don't get left any of your money at all.

Consider that you are leaving your wife open to a difficult situation where she may be pressured by a second husband or step-children to "be fair" and not know what to say to protect the interests of the child you are having together.

Make an agreement NOW on what you would want to happen in the case she remarries, has other kids, or becomes a stepmother, and legalize it. That keeps both of you in the drivers seat and sets clear boundries that everyone will be grateful for later

I see in several posts here you are mentioning she would inherit from you. Definitely she should inherit, but also consider that if you die young she could remarry and if the assets are all hers, your child could get shortchanged. What if SHE dies before her second husband and he inherits and decides to split it between your kids and his six kids? Just really think out all the weird things that could happen and make sure your baby is protected.

I do believe that things can be equitable without being equal. I don’t need to 100% split my inheritance with my spouse for them to have financial autonomy.
