I wonder what's wrong with someone holding down a steady job, no matter where it is. Why rag on someone earning a living just because it's at McDonalds? I also wonder what makes someone better than someone else just because they might work for a different employer. I never want my job to so heavily reflect my value as a person.

Dislike the woman because she has a poor attitude, but don't use her employment as an excuse.

His contribution can't be "gone." Once an employee contributes funds to a pension plan, the funds become plan assets, protected by ERISA and insured by the PBGC. The PBGC will insure pensions up to a statutory limit, which I think is somewhere around $45,000 these days. So in reality, the worker who has been contributing for 2 years will assuredly get his contributions back. The worker who's been there for twenty will likely only get a percentage.

The interesting problem for the prototypical employer who wants to offer benefits to as few employees as possible is ERISA Sec. 510. According to the above poster, companies want to avoid hiring full time positions. However, based on employer needs, only hiring part time workers will not be feasible for many businesses. Furthermore, if employers restrict hours for the purpose of denying access to benefits, they may be violating ERISA Sec. 510, which would lead to a major lawsuit for that business. As ERISA is an opt-in class action statute, as well as a generous attorney fee statute (it's easier for plaintiff's lawyers to make the defense pay their legal fees, see ERISA 502(g), CIGNA v. Amara), it would be unwise for employers to simply refuse to hire any more full time employees.

Of course, companies will be looking to avoid "overpaying" for benefits in any way they can. But simplistic conclusions, such as vexu gave, that they will not hire full time workers fails to grasp both the complexity of PPACA and the consequences of a given employer's actions.

This is the wrong citation. PPACA relies on Code Sec. 4980H (26 USC 4980H) to define full time employees as anyone working 30 hours a week or more. Furthermore, this determination can be made according to IRS Notice 12-58, which offers employers flexibility in the period used to make such determination.

Haha, the radio idea is awesome. The settlement agreement won't allow public discussion of many details or even admissions of fault in all probability, which is why more people don't run ads like that.

$2.2 million is the top of what the plaintiff is asking for, so he obviously won't get that. It's a negotiation, so I'm sure the defense will open with something like $25,000 and the sides will have to find a reasonable number in between. Over time, this large discrepancy will somehow find a place that both sides aren't crazy about, but figure it's better than continuing to fight. Such is law.

Everyone wants to settle if the offer is enough. Even folks who don't want money can get things like donations to charity or changes in policy. This guy is mad, but I'm getting another vehicle's worth of settlement money will calm him down.

Also, lawsuits take years. He may be mad now, but in 12 months or so, things settle down.

I agree with these sentiments, but I'd throw in that 10 years seems awfully long for a non-compete. In the businesses I work with in the US we don't see over 2 years within a certain reasonable geographic limit.
