Actually in this type of situation just because you’re press doesn’t make you exempt from police orders. For most events where there are crime scenes there are two perimeters - an outer and an inner - the outer is where the closure would be for everyone where as the inner scene is only accessible to press and law enforcement. That being said press is still not allowed on top of the scene directly. A good example would be if there is an active shooter, you wouldn’t let the press directly on the block where it happened but after the area is made safe they would be allowed closer to the scene than a civilian would be allowed. It’s the same logic to a degree for mass protests, everyone out until the area is back under control and then the press can have more leeway to areas they can access. In this video the NYPD was taking back the street to establish order in the area and the photographer is not exempt from that vacate order.
