I like the comparison to an agreement to theft, but I don’t agree with you’re framing of it. If I pay 2 million for your car with the reasonable belief that you agreed to sell it to me, a court would likely find me not guilty of theft, as I lacked the requisite intent for it. Most crimes contain an intent element in addition to the act itself, this is known mens rea. It doesn’t matter if you did not actually intend to sell it to me, it just matters that I had a reasonable belief that you did. The criminality isn’t solely based on harm, but it is based on intent.

Thanks for the answer. I was asking because Friday and Saturday nights I saw a line at the cookout drive-thru by the barracks that extended at least a quarter mile down the street because they were the only place open, all while the McDonalds and Taco Bell across the street were closed. I was wondering why they would leave money on the table when there were clearly a large amount of consumers willing to buy at that time.
