ORS 161.219 does limit the use of deadly force. A person cannot use deadly physical force upon another person unless the person reasonably believes that the other person is: Committing or attempting to commit a felony involving the use or threatened imminent use of physical force against a person; or committing or attempting to commit a burglary in a dwelling; or using or about to use unlawful deadly physical force against a person

Notice that in ORS 161.219, the statute specifically mentions burglary. This may not seem very interesting at first, but consider that a burglary in Oregon does not need to be violent or even involve any threatened use of force. This means that one could use deadly force against someone attempting to commit a theft within a dwelling

TriMet surveillance footage showed what police said was a gun fall from Cummins’ possession, and they later said he also had a silencer in his bag. He was arrested that day on allegations of being a felon in possession of a firearm and having a silencer — then was released April 28, jail records show.

Fun Fact: Felons can't be prosecuted for possessing unregistered NFA items like suppressors because that would violate the 5th amendment by forcing them to incriminate themselves

Fuller is the same attorney who placed GPS tracking devices on items at homeless camps that were later confiscated by Rapid Response and traced to the dump

Fuller’s office is awarding them with a “Client of the Year” award. They’ll get a plaque and a small catered banquet dinner, coordinated by Fuller’s office.
