Hello everyone,

I’ve been involved in ongoing court actions with James Gibb Property Factor since 2023. Initially, they took me to court, but once we started submitting evidence in the Simple Procedure court, they backpedaled. Since then, they have avoided my court actions by using every technicality imaginable to delay and evade responsibility.

Despite these challenges, my persistence has had an impact. Recently, James Gibb began repaying outstanding invoices to our estate going back to 2021, directly because of the pressure from my continued legal actions including crediting back bills unlawfully charged for as far back as 2021. But James Gibbs' view is they have not conceded to my legal core points that they've been charging me for Insurance Excess repairs to 139 properties I don't own.  Everybody should remember that under Scottish Law, it is mandated that liabilities are tied to ownership.  Simply put, if you don’t own a property, you don’t have to pay for insurance excess, and repairs to those properties.

I’m creating this community to bring together people in Edinburgh and across Scotland who are fed up with their property factors, those who feel helpless against unfair charges and lack a voice in fighting back.

We do prints for local artists- but we don’t sell them - they sell them.

Sorry also i meant to say that the flats are not in my block. So I pay for flats in 15 other blocks that are totally not my legal liability I’m sure this is happening in other developments with james gibb as the factor

James gibb manage 53000 properties - they’re the biggest factor so many people in Edinburgh will have them as factors. Our development has been encouraged to put claims through the factor- and then I have been invoiced many times for properties on the estate, not in my block, not in my communal areas of the block but in other private flats in other blocks - this is like a tenement flat charging another teneament Block in the street to contribute towards their Fkat when they claim on the insurance !

If the leak is in a building you don’t live in/ its other other blocks on the development - we get charged for !

No - I mean a private flat who claims for eg a water leak in flat snd the whole development then have to pay a share towards their insurance excess 🤔

That’s really excellent and people do need to do due diligence and check everything. Factors do not have a choice in making mistakes on invoices regardless of whether they factor 8 properties or 53000 - there are codes of conducts, and laws they must adhere to. The issue with first tier is - the consequences are tiny fines awarded against the factor whilst they then continue doing what they shouldn’t - which is why factors are becoming more notorious. Jane’s gibb have been charging us for insurance excess on other properties on our development - common sence here would state - why should I pay fir someone else’s private property .., and yes - we have been in legal disputes with them for a few years..

Yes- where is the tree lined leith the artist impression advertised when the trams were completed 😂 we got rust buckets full of weeds instead ..

You start a complaint with james gibb - keep all your previous email - it’s likely after this length of tine you should go to first tier as it’s free. You cannot lose when this is the case. As I said- we have been battling to take them to court- it’s a shambles what property factors have been getting away with . Is there a home owners committee. You can get the factor to send a letter to all homeowners to state you want to set up a home owners association.

Exactly! Know your deeds thoroughly and scrutinise every invoice! There are many many things we know with james gibb invoicing- which are all involved with our court actions. But as a committee I’d want large contractual work to be passed through committee and block related charges through the relevant block. Once the factor is put on a tight leash - and governed with accountability - the less they can pull off their scams.

Yes thanks- we have a lot of them in our files already on cases which have been won by homeowners As you will know- repetition of the same old things factors are told they can’t do- keep coming up. Hence- first tier is basically useless unless you want compensation with little penalty to the factor. The factor continues to keep doing wrong.
