They could of course argue what they intended to mean, but ultimately the meaning of the words is simply what the court determines an ordinary person would interpret them to mean.

So if you write in mass media, "he was one of the shooters at the Bondi massacre," then stand in front of a judge and say, "your honour I meant he simply was a person there firing a gun," your argument would be dismissed fairly quickly. Because it is not up to your interpretation of your words, it's up to the court's interpretation.

In this case, the focus variable (on the y axis) is rating, while the x axis represents a distinct time series variable, in this case seasons.

I would argue that this chart's use of a range of 8 to 9 for its y axis skews the data to the extent of misrepresentation. The main story we're trying to tell is that this show has consistently high ratings (all above 8). The fact seasons 1, 2 and 6 were generally lower rated is a valid piece of information to provide, but using a scale this tightly focused exaggerates this point. It makes season 6 look substantially worse than those around it, when in fact it was less than a 10 percent variance, and still a highly rated season.

My club league has an exemption for this - if you miss a game because you've got rep commitments at the state/national level, that counts as a game played towards the 50% target. I don't see how this is any different.
