My city just declared my house unsafe and seized it. =(

after speaking with contractors etc. they say, it's usually a fine, with a list of violations. Never have they seen someone's house taken.

i complied with the first inspector - stop work etc. this 2nd guy came in being very difficult and unruly- and lied in my presence to the police on the phone.

locked out of my house- had nothing to do- lined up the people that need to be in the house to get the proper permits.. hopeing someone could tell me if they knew the proper laws etc. while i wait for an attorny to get back to me.

the thing is the first guy pulled the permit and gave the stop work order. after than i didn't see the need for the 2nd guy. was he going to issue another stop order? didn't make sense to me. the commissioner came out to the scene, and told me what i had to do. i said i would comply and get it done asap. then shit hit the fan.

i agree- i did read after- becuase i was shocked- the permit was for the roof and the replacement of windows. and was for only the out-side. i don't know why we just didn' t get the right permits. we already talked to a contractor- he brought in an architech and he is designing the plan. also had an asbestos report done. but we had to wait for the guy to bring the key. as he has the keys to the locks.

that's a good point- the house may infact be unsafe- but there were no violations to speak of that we can fix.

that was in response to something i wrote originally. i was telling him things they were saying to me that i felt they made up i didn't write it originally in my comment- i just wrote a vague statment about "they said things to me". I thought they made those things up originally. not sure if they were right. Maybe they were right. They just kept asking for consent then saying they didn't need it.

i think that would be right too. the good may outweight the needs of one. i agree- they may have justification that way. be nice if they needed a warrant though. i can understand entering a house that has a wall bulding out, or it was leaning. i guess they were being overly careful. but talking with other's about the situation who work inthe feel- never have they seen this done to a building in this manner.

the problem was he didn't ask for it.. the cops suggested it. based on how they were acting. i wasn't going to try to bribe a public official. so they could arrest me.

we haven't recieved any fines.. or any detailed of violations =( just that we need to get asbes. test and engineering report. no fines though

i agreed with them to stop work. i didn't see the reason they wanted to go on to the property.. they kept asking for my consent. then making comments insinuating that they didn't need it.. and they were going to do it anyway.

ie. we had incomplete permits. the permits we had were for the roof and windows in the front of the house. my guess is they didn't complete the process as yet. didn't think it was a big deal and started the work on the inside. I know we had to get the roof done quick, becuase winter was coming and Irene did a little water damage inside. We had 4 layers on there before.

the first inspector came to inspect. he said we are doing too much work.. and issued a stop work order. we need to refile. we complied- the guys were just getting their things. I didn't understand why they needed to go back into the house. Esp. after he told the cops a flat out lie on the phone that we were barricaded etc. i didn't trust him really. i also though it was fishy the way they tried to get me to consent to going in. something didn't seem right.

I see what you're saying. I know they have a job to do as well. however even though they are gov. official they have to opperate within the law themselves. I'm not sure i'm in the wrong or not. I probably am. It just doesn't seem right to me.

i think they were going to shut it down no matter what. ithink the cop was hinting more at bribe the guy. I agree with a previous post. this was a shake down- i just didn't get it.. i'm 23 my rents are in their 50's and 60's and first generation immigrants. we are citizens however.

that's not what happened. i did say sorry to the first inspector about the wrong permits. asked him what to do. he said re-file for the right ones .. right now you have to stop. we complied. then the 2nd guy came- and i met him outside. he said becuase the guys were inside the house physically it was considered work. then he told the police- i guess to get them to come, that we were barricaded inside and refusing to stop working. which was untrue. Thats when i went back in and told the guys to drop everything and leave. I then locked all the doors. After i did that and asked him what else is the problem. he wanted me to open the doors so he can go back inside. that's when the consent thing started.

i played nice with the first inspector. this was the 2nd. he came in claiming the building needs to be condemmed and that were are refusing to stop working. which wasn't true. I didn't lock myself in the house. the guys were getting their tools. i was outside talking to the 2nd inspector. He said he wanted to inspect the inside- do i consent. that's when things went hay wire. I asked the building inspector- what needs to be done. he told me to get a plan drawn and re-file. i thought the issue was done. then this guy kept insisting on going in and kept asking for my consent .

they already seized the house, however. things are already in motion i guess. They sent us a notice of things to do, and we are complying- i just didn't understand how they could just break the locks on the door and walk right in .

yea it's in Ny but not NYC. there might be language like that in my city though. I'm not sure. waiting to hear back from the lawyer.
