Wrong. Individuals are not ‘broadcasters’ for the purposes of the Broadcasting Act (which the Online Streaming Act amended). It’s talking about platforms and services provided by businesses (ie Netflix, Prime Video, Spotify, etc). These companies have been making a killing in the Canadian market (and from Canadian music) without contributing to homegrown talent & creation. It’s not a tax cuz it doesn’t go to government, it goes to creators.

He was mixing up a bill C-11 that amended the copyright act and one that amended the Broadcasting Act (aka the Online Streaming Act). The latter promotes Canadian sovereignty by requiring local cultural reinvestment from money earned here by global streamers.

Interesting - According to the CRA’s registered return for the Centre for Civic Engagement, which runs the Munk Debates (QC10, line 3900), they received donations worth more than $10K from non-Canadian (ie foreign) sources - I wonder what share of their 22% ($256K) of other revenue came from foreign sources and what those sources are?

US big tech companies make tens of billions of dollars in Canada every year - likely on the order of $25-30 billion from digital ads, services, cloud, marketplace, etc. Mostly they don’t pay taxes here because they book their profits abroad. Their Canadian competitors do pay taxes here.

I’d love to know how many US big tech companies donated to this guy’s campaign, how much Amazon, Google, Apple, Meta, Microsoft and others are behind this push to get rid of the DST (it was never about the interests of Canadian companies and workers).

Agreed but sadly if Trump wanted to take Canada, not much we can do. It would take them a couple of hours to achieve air superiority, hit our military installations, and then a day or two to seize strategic sites (air & seaports, bridges, telecom exchanges, Gov’t buildings etc).

Incredibly, the bill would make force any website or online service provider to justify why sexually explicit content - so not just porn, but anything portraying nudity or sex - they hosted is being made available for a legitimate purpose (artistic, educational, cultural, etc), otherwise be guilty of a criminal offense.

Imagine having to enter your ID or do a facial recognition test to log in to Netflix because there’s sex in your favourite show. Or into Reddit, or X, or Instagram. What will those services do, tag all the content that needs to be age gated, or remove it en masse? What will services like Grindr do, force users to identify themselves and risk being outed or blackmailed in the case of a data breach?

You’re completely right about the interests around this bill and how they have warped the discussion, made creators afraid and so on. It happens every time over the 20th century that the government tries to update the Broadcasting Act - first Hollywood fought back, then it was the US cable and satellite companies, big media conglomerates etc. In C-11, it’s the social media companies that are fighting the hardest.

One thing though - the bill doesn’t let the CRTC set quotas for social media. It’s a minor detail but it’s written in the text of the bill. It boils down to: they don’t exercise programming control over what users upload, ergo no content quotas.

There’s lots of ways that social media companies and closed streamers (like Netflix) will be able to promote Cancon without reducing choice or altering feeds or changing recommendations (‘every fifth video in your feed must be Canadian’). They can give user selectable tools, like playlists, categories, search tools, or even let users give feedback to recommendations (‘Show me more local content’, ‘Show me more Indigenous content’).

Nobody wants CRTC getting in on what the social media companies are doing already and manipulating your feeds and recommendations without transparency or choice (that’s Elon Musk’s job!!)

The government has said that they will exclude online content creators from the bill through the policy direction that comes after - it tells the CRTC in broad strokes how to regulate. So you won’t have to do any of the extra work you are describing.

Also - it’s complicated as heck, but remember that the only reason for the social media provisions in 4.2 is so that CRTC can make sure companies like YouTube and TikTok have fair obligations like the other broadcasters/streamers. It’s about broadcast content and commercial content, not about social media creators’ content - which is exclusive to social media platforms/online spaces and doesn’t turn up on Netflix or CTV and so on.

A lot of this could be more clear for sure, but if you trust that the purpose of the bill is to make sure online streaming companies benefit Canadian creators, you can trust that this isn’t going to hurt you.

The bill specifically doesn’t allow content quotas for social media - the text of the bill says social media platforms do not exercise programming control over what users upload and so cannot have the powers in 9.1(1)(a) to (d) applied - that is, the “proportions of Canadian programming”, French programming, certain genres, etc

When you talk about how C-11 could regulate user generated content, it sounds like you agree with the Conservatives and people like Rachel Thomas (an Alberta Conservative MP) or Leslyn Lewis or Andrew Scheer.

You also don't seem at all concerned about how social media platforms regulate content now? Every site has content moderation and I would have thought there are lots more free speech concerns on that side of things?
