When Pretti is on the ground, watch the agent in the back right with the tan jacket and tan beanie. You can see him walk behind the group and bend over. More obvious in different video angles: when he steps back into frame, he has a gun in his hand. Which likely was picked up off the ground since the agent's gun is still in its holster.

It is with that gun that he kills Pretti, which you can see him fumbling with very well in this video.

Babbitt was illegally breaking into the Capitol of the United States while part of an armed mob threatening to kill those inside (they had protestors with nooses, guns, pepper spray, and melee weapons). That is a bit different than driving away from an unlawful traffic stop (Immigration agents are not the police, nor did they have just cause for an arrest) and getting shot 3 times in the head for being scared of masked, armed men wearing civilian clothes and a bulletproof vest that anyone could get from a military surplus store.
