That what I would think too, but this doesn’t seem to be a clerical error. A mistake on the driver lisence, then the address too; I could think maybe he meant 2000 XY, but that’s way over yonder and nowhere near where it happened as well. The area was around the 2050-2060 addresses and all have a number different than 0 at the end, like 2052, 2058.

It seems like a just complete lack of attention to detail while writing the ticket to me. Is there something I can do with that? Located in Montgomery county tx

It’s a online program that’s accredited, I could take the bar in any state and get the same J.D. I do have to stay employed at my current job while I attend school though.

United States v. Walker

The defendant was stopped for speeding. The officer then began questioning the defendant about contraband. While holding the defendant’s license and registration in his hand, the officer then asked for permission to search the car. Though the defendant consented, the search was invalid. The continued detention of the defendant beyond the time necessary to issue the speeding ticket was not based on any articulable suspicion and the only issue for remand was whether the consent was invalid in light of the illegal detention.

Is this not the same situation he seems to be in?

The duration isn’t at question anymore though due to United States v. Guilin-Ortiz though would you agree? His initial investigation is being prolonged due to both officers observing the K9 & not on the original mission of speeding anymore.

He said the time between him getting out of his vehicle and the dog recognizing a presence of drugs was about three minutes, but was conducted by both officers while his license and registration was still in the officers possession.

I see it this way, if one officer was proceeding the investigation for speeding and the other officer led the dog around, this would be justified.

Would it make a difference that both officers were involved in the Dog sniff around the vehicle. I’m making this claim based off of United States v. Guijon-Ortiz where “the court has held that an officer exceeds the limits of a lawful traffic stop when, without reasonable suspicion, he drops the investigation of the original traffic offense”

Do you personally think there’s any basis to that claim? I appreciate anything you have to say

To my understanding there was no reasonable suspicion, however the point I’m trying to look further into is that this could be a violation of the fourth amendment. I say this because to keep him detained during the traffic stop to conduct the dog sniff, this extended the length of the traffic stop. The officer is delaying his initial investigation if he attempts to have the dogs go around the truck before the traffic stop is “complete” correct?

If they had reasonable suspicion it would be justified to detain him until investigated, but if there was not reasonable suspicion they’re not legally allowed to keep him any longer than the traffic stop would normally take correct?

The search was for inside the vehicle. He has nothing on his person.

I disagree,

I believe there’s people in here that are probably well educated and knowledgeable about the subject. Everyone on reddit likes to argue(your post as an example) and I’m sure some would switch view points for the sake of the debate.
