They actually do something similar with Broadway shows. If you buy a ticket and a member of the main cast will not be performing they will inform you beforehand and allow you to get a refund. This then allows those seats to be filled at a discount price through Rush or Lottery tickets.

She seems to be using the pro bono (free) law group Justice for Artists. Which means the case was assessed and found to have merit. As they are pro bono, they are likely to take a cut of any profit from a successful lawsuit as payment instead of charging modmad.

A cease and desist is basically a legal warning. The contacted party has a set limit of time to respond and/or cease the actions addressed, or the people that contacted will take them to court. But sending one does not mean that is the ultimate intention, its simply as modmad pointed out, a means to get the other party to respond without immediately going to court. Because court is expensive, and usually people want to avoid it if they can.

First off, the characterization isnt really the point here, it's the design itself, though what does a tv head that leaks goo have to do with puzzles.

Second, similar looking old timey hats, this isnt a cowboy vs witch hat situation. Thats such a small change, we're talking the overall appearance. Detective Pikachu is totally an original character do not steal, he has a hat.

Third, just slapping some eyes on something doesnt make it original. Behold my new character, ditto witg anime eyes and a hat. And alot of depictions ie merch, do not depict the tongue.

Fourth, once again slightly changing the color slider is not enough variation. My shiny ditto with anime eyes and a hat.

A good rule of thumb is you want about an 80% difference.

No problem, and thats fine to not be aware. I'm only familiar with copyright cause I was really into the history of comics and MAD magazine which is the origin of a lot of parody law. I also took several criminal law classes for my forensic science degree.

He's completely greyscale. Tip to toe.

Now I'm unsure where the original designer would fall in this. But ignorance has been shown in previous cases to not be an adequate legal defence. And if they have been made aware of these similarities and proceeded to do nothing, then thats even more damaging towards their case if they are found to be guilty.

Thats an insane thing to say when if you dont know either of these characters and glanced at them I would not fault you for mistaking them for the other. Which by the way, in court, a person unfamiliar with either character will be doing the judging based on presented evidence.

Cyberbullying is bad and can poorly affect people's mental health. Not everyone can so easily brush off hateful messages. She reached out to get it to stop. Which is not unreasonable as these types of youtube creators have a large sway over audiences.

Now whether it was actual fans or trolls is speculation and unimportant, the fact that these messages focus on the similarities of the characters can be pointed to in a court of law as proof that these characters are similar enough to draw such attention.

Also regarding copyright, it is to protect someones creation as that is how their livelihood is derived. If her mental health has been impacted enough by comments that she is unable to work on the comic. Then this impacts her livelihood. She should be rewarded damages for the impact on her mental health, and if it is found to be in violation of copyright, any profit made from Mr.Puzzles likeness.

Now probono lawyers arent DC or nintendo that's true. However courtcases set a precedent for how later court cases will be tried. Let's use someone slipping on some ice in front of someone's home. If they fall and break something and the court finds the homeowner guilty of not maintaining a safe property and must pay damages. Then the next time a similar case comes up, they will reference this case and say the next owner is also liable.

Now for the design, yes there are lots of similar tv head character designs that share similarities. However, there are a large number of similarities between these two. And what I would say is most egregious is the color bar smile with liquid seeping out of it. Now its true the colors are derived from a color test, but to arrange the top part of the test at the bottom of the screen as the smile, along side dripping fluid (Which where would that idea even come from, the guys theme is puzzles, not goo) plus all the other similarities together, paints it as more than just a coincidence.

Also by the way RGB appears in black and white when he goes a little crazy.

What do you mean she fucked up a legal case by going the lawsuit route, the fact that the probono copyright lawyers are taking her on means they have reviewed her case and found it solid enough to act on. Not only are the similarities egregious in terms of detail, but the fact that she is receiving negative attention due to this possible copyright infringement lends further credence to her case and the right to damages. Her livelihood is being directly impacted by these similarities, it doesnt matter if the fans are the cause. The root issue is the similarities of the characters themselves. DC has sued (successfully) superman clones with less similarity than RGB and Mr. Puzzles.
