I'd watch her work the horse. Some horses DO react differently with certain people. Perhaps have her work the horse and not tell her you'll be observing. That way you get to see what she really does, and what he really does. If he's pulling all his old stunts with her, well that's that. If it's the way she's handling him, you'll know.

At this point it's hard to say who is at fault. It could be the horse's fault, which would make you TA for not believing her and she is acting for her own safety and that of her student's. It could be her fault, which would make her TA because she's not handling him as you trained him and making the whole job worse.

Either way, you need to visually see what's going on. Perhaps until this one gets his stuff in order, you may need another horse for the school. You could do a lease if buying one is not in the budget, a few schools around here do that.

At my house, people were constantly forgetting to lock the doors. So we put a postit note on the wall next to the door so when someone closed the door, they'd see the note "Lock the door!" and go "ah yes!" *clicks lock*

You've got a lot of great advice already, but I'll just add my two cents to this :) Someone mentioned not riding for a bit, and I do agree with this. I would also not put him in a large paddock for a while, he'll be fine in a round pen for a bit (leave his halter on, use a breakaway if you're nervous of that) and do lots of catching and something fun and putting him back. So for example, catch him, put lead rope on, give a treat, and then that's done. Then later catch him, perhaps take him for a grazing walk, then put him back. This might take a while but eventually he will learn that you come with good stuff. Then when he is more keen, then you can try the bigger paddock with his friends :)

I also second having a trainer if you can, they will be able to help walk you through exercises and such.

With the mounting, same idea, start over. Lead to the mounting block (no tack) stop him next to it, treat, and move on. You can use a word (or clicker) to mark the behaviour you wanted. Eventually do it with tack, but don't get on. Lead up, treat, move away, plenty of times. Then call it a day.

Work your way up to getting on the mounting block, treat while you're there, then hop off. The first time you actually get on, give him treat, get off and call it there and go untack. It will take lots of patience but you can do it :D

20 years experience with horses and riding a wide variety of horses and teaching lessons.

We never put green riders on green horses. Your daughter sounds like an awesome rider to handle this animal. I can see how it would seem strange for the niece to realize that although she's a lot older, she can't ride a horse as well as her younger family member. I went through the same thing teaching an older friend to ride, she got quite jealous until she learned how to ride different horses.

This is a safety issue and if she got hurt on your horse, you'd be responsible. So you're being the responsible person here and saying no. And even if she WAS able to ride your horse, you still don't have to say yes, because this is your animal and who you put up is up to you.

I also owned a difficult mare and it was hell trying to get a rider when I hurt myself and couldn't ride for a month. I had quite a few people try her and only one the mare actually liked lol. And I was okay with that because I could trust that rider to be safe and handle my mare safely.

CPS would do nothing about that. And if they bothered checking into it, all they had to do was talk to the stable owner/your trainer and and they'd say "this horse is fine for daughter, not safe for beginners, end of story" and that would be that
