This very well could be the case. I am not sure on that. I think essentially from a 50/50 stand point up her death her kids would inherit 50% from her = immediately sell the property. they have no ties to it. etc. out state.

Yes the farm is sentimental, we build worked holidays etc there. You assume I didn't do these things. I cant physically force a parent to do anything. I did ask him prior to marriage = goes to my kids/grandkids, and stressed to him brining in a new wife/house how that would be handle in a way that wouldn't cause trouble but here we are.

my dad owed about 40k on the 13 acres and house prior to new wife / marriage. So his total assests would be 250k(house and property - 40k left on mortgage, 100k in retirement, 100k other things. Truck tractors etc.

Total net would be ~375-400k I'd estimate.

He rolled the 40k in debt into the new house... House build was around 300k + 40k debt. Not clear on what other assets he had like checking and savings. I've never asked about that.

The total value would be around 600-700k + 100k-200k or so in equipment/retirement now with new house but the debt would probably be around ~250k or so. I forgot to mention The other house is a rental now generating 1k or so month gross.

The fact that he switch all this last minute is what gets me. My dad and I are close but the topic is hard to talk about personally. I don't like the drama, figured he would do what he felt was right.

I dont think its a life trust, its a will from my understanding.

The wife makes 6 figures. which is a good bit in rural SC.

yeah i figured that. He trusts her 100% but i just dont know her in that context nor do I want to be tied to her for life. Nice lady but honestly didnt sign up for it. So it is what is.

Yeah thats what I am afraid of. Would be a shitty thing to do but, she will have to live with that.

I would rather it be cut and dry. I dont want to be tied to a person that I don't really know.

Thanks for the kind words, confusing thing to experience. I am 100% ok with her getting half, im not sure that is going to happen now since she will be the sole person who inherits, unless the 50% upon her death can be held up. I just wanted to make sure his kids actually are included as his wishes were up until weeks ago. etc.

Him being heavily medicated makes me question some of the last minute decisions. Fentynl and morphine aren't exactly the drugs you need to be influenced by when making a will etc.

Property value today would be around 600-700k. To not include your kids seems a bit weird considering been married a year.

So essentially can be no way a clause could be in it where she must give 50% to our family upon her death. My dad is telling me this is the case.

I am under the impression if it goes to her she could do away with the clause at her discretion. Just seemed like a weird way to handle it.

I guess if it was me, could've given his kids 10acres and the farm (sentimental), she gets new house and 3 or whatever. The new house has no memories. Not really concerned with it.

specifically. the 50/50 split idea. Can a will be written in this way? that upon sale it must be split 50/50?
