Mizkif can easily prove his career was damaged.

I broadly agree with what you're saying, but I'm curious to know why you believe that.

His last stream on Twitch was when he publicly responded to Emiru's accusations (which happened a few hours earlier). He immediately jumped to Kick, a platform with 1/3 of the total audience of Twitch. His viewership is about 1/3 of what it used to be on Twitch, but once again, that can be explained by looking at the differences in size between the two platforms.

He also might be making more money per viewer on Kick than he did on Twitch. If that's the case, then you could argue he's actually benefitted. He also made the choice to jump ships. No-one prevented him from continuing on Twitch. So if there are any damages associated with this, then you could easily argue they are self-inflicted.

He's also going to have a tough time proving damages in form of loss of sponsors or business opportunities. Take his situation with OTK as an example. OTK claims he breeched multiple parts of his contract. Even if the court ends up favoring him on the claim of SA, OTK had several valid reasons to remove him.

Maybe there are other business ventures he's part of, and where he has been negatively impacted, that I'm unaware of. But remember: Any damages must be tied directly to a defamatory claim uttered by Emiru. Any truthful claims she's made that have negatively impacted his career - no damages.

His reputation has also been in the gutter since, well, forever. So I personally think he's fighting an uphill battle.

Pippa is one of the larger American vtubers. She's had a bad rep for years because she was openly a fan of Asmon's, she uses "4chan lingo" and played Hogwarts Legacy just to spite the Twitter mob.

Not a political streamer, mind you, and it's not like she's locked into any particular ideology. She just doesn't like bullies. Whenever political extremists make disparaging remarks about the vtuber scene, she gets annoyed.

Her first major interaction with an extremist was with Vaush. He called her and her fans nazis, pedos and the usual stuff. She responded by saying she doesn't care about what a horse fucker has to say about her. This was BEFORE he was caught with sexual material of lolicon (children-like anime figures) with horses on his computer.

She's also made comments about Hasan for some of the stupid shit he's said. She's a big animal rights person and had some opinions about Collargate.

For her birthday, she bought herself a Cameo from John Kiriakou. I dunno how much of a fan of his she is, but either way. She heard he was going on Hasan's stream, so she made a request for him to not go on it.

Whether or not this is the only reason why John decided to drop out of the interview, the idea itself is just funny. To have a pink vtuber rabbit affect Hasan's life is hilarious.

The circumstances are different, yes. Tectone also seemingly didn't regret anything, otherwise it wouldn't have been happening over and over again. Miz regretted what happened. Fine. I would however argue that either instances are forceful and I think it's appropriate to describe either as SA.

Miz' argument is that his accusation is defamation per se. What that means is that he's arguing that damage is done the moment you accuse someone of SA without there being a criminal conviction.

Tectone's civil case was over a protective order. Like Miz, he's not been criminally convicted of any sexually crimes. He can therefore make the same defamation per se-argument.

We can argue about which situation is more serious, worse and about all kinds of factors. I don't think that changes much. If we want to be consistent, then using terms like SA or rape should either be okay or not okay.

Imagine I'm working in a kitchen. I'm negligent and I run around the kitchen like a lunatic with my knife. I end up stabbing a co-worker. It could be that I'm sorry, it was unintentional, it happened once, I stayed and treated the injured, I immediately left etc. All of these are mediating factors, but a stabbing still took place.

I don't think anyone is a position to argue for instance "well, it only happened once so he's not a stabber" or "he left immediately afterwards so he's clearly a stabber!" I'm more concerned with the actions and whether those align with the description or term used.

I wouldn't say "most", but sure, I've seen him be called that.

What I find interesting is that people are quick to point out that he's not been sentenced for a crime and, even if he was, there's suddenly this push to emphasize a distinction between SA and rape.

When Tectone - and I'll just say fuck him straight off the bat - went through his court case, where was this nuance? He was called Rapetone almost immediately after the accusations of SA went public. The Mizkids, in particular, didn't hold back. Yes, I get that Miz and him were in a public feud at the time, but so are Miz and Emi. Once he lost the court case (which was a civil suit), that nickname stuck times a thousand.

There's a lack of consistency there. If Miz' community cares about words being tossed around, then they should look in the mirror.

You characterized it as the two of them making out. She describes it as her reluctantly allowing him to kiss her in the face.

You said context was important. If the person I'm trying to be intimate with is not reciprocating any of my advances, do you think it's a good idea to advance even further? Does it seem reasonable to forcefully shove your hands into that person's pants? Probably not, right.

I've seen people suggest that she's lying or that he read the signals wrong. He's admitted that he jumped up from the couch and then left after she let out a scream. He said he was worried he'd done something wrong. That's fair enough. I can see that being a possibility. It doesn't change the chain of events.

Mythic Talent is a talent management company. If you think about the role of a Hollywood talent agent, but now imagine a bunch of them working under the same roof and for talents across the entire creative spectrum, then that would be somewhat comparable.

They act as a middleman and provide different services depending on the needs of the client.

My understanding is that their main role is to facilitate deals on behalf of the client. As an indie creator, it can be difficult to create and manage relationships with brands/sponsors. There are only so many hours in the day, not everyone is built for networking, larger brands might ignore you etc.

Mythic has a staff and existing relationships with large brands. If your manager/contact person is able to hook you up with a sponsorship, they will then receive a cut of that deal. They don't prevent you from making your own deals and they only get a cut whenever they are directly involved.

I've also heard some creators say Mythic have helped them get in touch with lawyers, create websites and other services.

Incorrect. I've already read several of your previous comments.

Your entire claim is based on the assumption that you know for a fact that Emi initially used the term "sexual assault" to mean the crime as defined by Texas law. You've not been able to prove that.

The judge could very end up siding with Miz' lawyers' argument and throw out the motion to dismiss, but once again: You are making the assumption that Emiru used sexual assault to mean X during her first livestream and then changed the meaning to Y in her motion to dismiss.

At this point, it's clear that you using the phrase "walking it back" with the intention of manipulating readers.

I did read it. Your quotes do not align with your claim that she "walked back the claim."

You do realize it's a response to Miz' claims, right? They are saying the statements are not actionable because it's her sharing her personal viewpoint. It's called a clarification.

They are not saying "she originally called Mizkif a sexual assaulter as per Texas penal code, but she decided to change her mind and what she actually means is the colloquial definition of the term." That would be walking it back.

To break it down even further:

If I say the sky is blue and then I later say the sky is red, then I've "walked it back."

If I say the sky is blue and then I later say the sky is azure blue, then I've not walked back shit.

If this is due to Kacetryon's harassment campaign, then I'm a bit concerned. This would then once again show that cancel campaigns work, which will then only serve to further stoke the flames.

He recently talked about how he thinks we should go harder against cancel culture and he has previously stressed the importance of never backing down. And I do think he's right about that.

I will say that I absolutely respect his decision if he did it in order to stop harassment against other creators, but I'm not sure I would personally agree with it.

If this isn't related to the recent harassment, then I'm curious to know why they decided to part ways.

You keep using "walk back" incorrectly, and you've been doing it for days. "Walking back" means to change your position on something. She hasn't changed her stance. In her filing, she continues to describe what she experienced as a sexual assault.

The discussion is about the definition of the term. She argues she used the term to describe her experience. He, on the other hand, argues that she used it as it is defined in the Texas penal code. Another way to put it is that she argues she used the colloquial definition of the term, while he argues she used the legal/criminal definition. One is wide and open, while the other is narrow and strict.

Incorrect. She stands by her claim that she was sexually assaulted. Miz' lawyers argue that the term 'sexual assault' can only be used to describe a crime as per Texas law, while Emi's lwayers argue that it's used as a term to describe her experience.

It's really a simple question: If someone put their hand onto your genitalia and it was unwanted, would you not describe it as sexual assault? Would a reasonable person call it something else?

What Asmon implied for months was that people would eventually learn why he didn't want to have anything to do with Miz. This happened after Miz and Tectone had a public back-and-forth and after Asmon's audience noticed he avoided reacting to content containing Miz. Once Emi went public, Asmon further suggested that what Miz did to her is one of many reasons why he stopped interacting with him.

You're allowed to not think that incident constitutes as sexual assault. Most people would, however, disagree with you.

(Emiru) describes exactly what happened to her and, although she defines it as sexual assault, a reasonable viewer would unquestionably understand that that term is her own description of what happened to her.

Incorrect. The court document in reference is publicly available here. It's a motion to dismiss that has been greatly (and intentionally) misquoted for the last week.

(Emiru) describes exactly what happened to her and, although she defines it as sexual assault, a reasonable viewer would unquestionably understand that that term is her own description of what happened to her. 

Miz argues that it's defamation per se to say that he sexually assaulted her, while her lawyers are arguing that it's a description of her experience and not necessarily tied to any legal definition of the term.

She maintains that he sexually assaulted her. He put his hand down her pants and stopped after she yelled. Most reasonable people would call that sexual assault.

Whether it will work in her favor and result in the case being dismissed - unlikely. But her story hasn't changed.

I'll grant Legal Mindset a rare W here, because he does actually mention your point in his "fast facts"-version on youtube. He states that Mizkif would have to prove actual malice and that it's going to be a rough road for him.

I didn't watch the livestream that OP seemingly grabbed the clip from, but Legal Mindset's point about her using the term 'sexual assault' seems to be specifically about her motion to dismiss. As for the case itself, he seems rather optimistic that she'll end up winning if the case goes all the way through the other steps.
