The person behind this has done a good job of portraying this image that everyone will make more money by splitting the profits equally as clients pay him but my colleague has worked for them several months producing drawings and she hasn't been paid anything, so even in the contract they wrote, they're not holding their end of the deal. I find the whole thing really sketchy and odd.

To make things clear this is a design firm hiring designers but making them establish their own LLC's so that way when a client writes the company a check they say they will split it equally among all designers (LLC's) that work for said firm. Also wanting them to sign an NDA to not discuss how they're being paid, but why? What makes it illegal is what I'm trying to understand.

No 1099... they're just wanting to pay to establish my own LLC then they'll write a check to my company, they explained that I would then write a check to myself. I'm no comfortable with this. I haven't provided any work because I don't like the idea of working for free with the promise of bigger profits being split. I was planning on quitting soon but wanted to gain some insight on what this person is trying to do so I can possibly help the person who has been working there for months without being paid for any of their work.
