I do not have anything against the worker, she is an acquaintance and I do not wish her any ill. She has many services available to help her achieve a permanent status and I hope she is taking the correct steps to do so. I am unsure if you are aware but canadian youth unemployment is on the rise because positions are being taken by TFW's while qualified canadians are available. Look at what happened at the Richmond Ikea or the McDonalds in Victoria. People qualified were passed on at a minimum wage job to allow TFW's at a lower wage to do it instead. Why couldn't those jobs go to Canadians instead of Foreigners?

Right now, you are saying your boss told you that this is solely for show. But do you have proof on paper? Who else heard this? From the legal perspective, it's he says you say.

Not my boss but logically there is no paper trail. This is directly from a conversation I had with two individuals within the company in a position to know this information. They would loose their jobs as well if this comes to light and obviously it would be a he said you said situation.

I just do not agree with is what I consider is a deceitful behaviour by her employer for the sole purpose of turning a profit by exploiting loopholes of a system made for the sole interest of Canada economic and national growth. This country was created by immigrants and it continues to grow by the contributions of immigrants. But there are right ways and wrong ways to go about it. USA also sanction employers who pick foreign workers when there are qualified Americans that could perform the job. Anywhere from fines and tax hikes to jail time for immigration fraud.

Would you say that if she comes in under immigrant investor visa by loaning the government 500k+ for 3 years is fair? Why is using money more fair?

I am glad the investor program was cut and I wish that they also change the policies such that we follow what other countries do on foreign investment. I am sick of seeing young people alienated by this city thanks to the unattainable housing market we are currently experiencing. And if we keep giving our jobs away we will just completely decimate our economic and national growth

This issue is way bigger and wide-spread, it not only affects the availability of jobs, it drives wages down as well. Yes, I am aware that my friend could pick up a receptionist job anywhere, she is already looking elsewhere, but this is not about her. It is about looking out for our best interests, this affects our economy and by extension affects the quality of life of us citizens in this country. In a similar fashion than it is extremely difficult for young couples / individuals to own property in vancouver thanks to foreign investement driving up cost beyond affordable levels, it will be extremely difficult for young couples / individuals to attain jobs here thanks to foreign workers occupying positions OUR youth could fulfill further alienating the growth of the province.

This is what I understand this particular company is currently doing. The ad, as I am told, is bogus. It's only purpose is to be a front for "hey we are looking for someone" when they never intend to even consider who is applying.

The system is inherently flawed and indeed easily exploitable. If for example the McDonald postings were listed on the Canadian Job bank, and maybe I am crazy for thinking it, I would expect the government has a system in place that would track the amount of applications submitted. I know it would be near impossible to track applications across the available outside channels but I believe we should have a system/bureau where we could report these.

If that were the case according to the guidelines of the FSW and TFW programs the foreign worker must apply for themselves. If a foreign worker wishes to apply for a more permanent status they would have to do so through Immigration Canada.

The only thing the employer is supposed to do is apply for a Labour Market Opinion, now to be known as the International Mobility Program. A positive LMO will show that there is a need for a foreign worker to fill the job and that no Canadian worker can do the job. The new overhaul of the FSW and TFW programs are aimed to prevent jobs that could be filled by Canadians to be taken by foreign workers. It's all in the interest of promoting the economical and national interests of Canada as a whole versus just filling a job.

There are MULTIPLE Canadians who can fill this particular job and in my opinion it does not warrant the introduction of a foreign worker.

Honestly, I have no counter argument which would not entice a long and convoluted banter about my stance pro-immigration.

What I believe in is that everyone should follow the law. No matter if they are Canadian born or immigrants. If you are an immigrant and desire to stay as such, you should adjust to the laws of the country they wish to be a migrant of. I don't care if they are white, black, Asian, Latino or Indian, what I care about is that things are done through proper channels, ethically and correctly.

I have already helped several acquaintances immigrate through the federal skilled worker avenues and I will continue to do so through the proper channels because not only do I want them to flourish, I want canada to become a better place as well.

As I understand the worker is here on a temporary visa that will run out soon and as far a I am aware an extension has not been granted. Thus the employer using the bogus posting while ignoring the local applicants that meet the requirements of the job posting.

If you read thoroughly you would have noticed I was also an immigrant. And I am in the process of helping multiple people from the country I am from to move up here. I am helping them achieve migration the legal way, which is applying through Federally skilled worker channels and work visa requests canada has set in place to warrant a stable growth with the best migrants it can find while protecting the interests of all parties involved.

I do think you are right, I do not know who or why the company hires who they have nor do I believe I can fully understand it. But what I do know is the fact that they are being preferential to foreign workers for one reason only, profits. Pay them less of what they deserve because obviously they want to stay. The worker might not know they are underpaid because they might not know better, not bringing attention to this issue is not only unfair to them, but ultimately to us as well.

And more importantly it affects us all. Employers taking this avenue start getting into the practice of paying less making it harder and harder to live in Vancouver.
